CABARRAS COUNTY, NC - WILLS - Jacob C. Barnhardt, 2 Oct 1894 --------------¤¤¤¤¤¤-------------- Last Will and Testament of Jacob C. Barnhardt In the name of God, Amen! I, Jacob C. Barnhardt, of the County of Cabarrus and State of North Carolina do make and declare this to be my last Will and Testament, as follows:- 1st At my death, it is my will that my friends and relatives bury me in a decent manner, suitable to their wishes and according to the customs of our Presbyterian Church, and place at my grave a suitable tombstone or monument to mark my last resting place, and all my funeral expenses and just debts are to be paid by my executors, herein after named, out of the first or any moneys that may come into their hands, as a part of my Estate. 2nd I will to my beloved wife, Jane A. Barnhardt, my Pioneer Mills lot containing about 9 1/2 acres, she to have the use of said property during her life with all the rents accruing there from: also 100 acres known as the Penick lands, during her life, and at her death said lands and lot are to be sold at public sale in separate lots and the money divided as herein after directed. I also will to her one horse and buggy and harness, two milk cows and provisions enough to support her and her stock one year out of that on hands or the coming crop: also all my household and kitchen furniture and any other articles indispensable not herein named, all other loose personal property to be sold. 3rd I will that my estate be equally divided, share and share alike, to my wife Jane A Barnhardt and children Alice E. Parks, Mattie J. Inery, Jno. A. Barnhardt, Mollie L. Cochrane, Laura J. Ingram. Thos. M. Barnhardt, Eugene C. Barnhardt and Nannie Misenheimer, unless otherwise specified. Those who have not had advances in an outfit for house-keeping shall be equal with the others as will more fully appear by an account kept against each one. 4th It is my will that my stocks and bonds be divided equally, and for that duty my Executors shall be allowed one per cent on the par value of same. After division what odd shares there be to become the property of Jane A. Barnhardt. I have 35 shares stock in Commercial National Bank, Charlotte, N. C., and will 4 shares to each one of my children: to my wife 3 shares remaining and one hundred and fifty dollars. All other credits to be settled according to law unless the heirs should elect to make a partial division. Any other lands that I may be possessed of not here-in willed, shall be sold at such times and in such a way, either public or private, as will best enhance the value of my estate and should my Executors not be able to settle my estate within the time prescribed by law, they are to have such reasonable time as may be necessary for the settlement of the same, so as to enhance the value of said estate. 5th My executors are hereby authorized in the foreclosure of mortgages to purchase lands of any other property for the benefit of my estate, and sell and make title to the same, either for cash or in time, so as to guard against as little loss as possible. And lastly - I do hereby appoint my sons Jno. A. Barnhardt and Thos. M. Barnhardt, my Executors to execute this, my last will and testament according to its true intents and meanings: and should there be any doubts as to the meaning of any portion of it, a just and liberal construction shall be placed thereon.
