CABARRUS COUNTY, NC - WILLS - Charles Barnhardt, Jr., 28 Apr 1845 --------------¤¤¤¤¤¤-------------- Last Will and Testament of Charles Barnhardt, Jr. The last will and testament of Chas. Barnhart Dec'd was produced in open court and offered for probate and the execution thereof duly sworn by the oath of L B Barringer being one of the subscribing witnesses thereof and there appeared to be no executor provided in said will or motion. Catherine Barnhart was appointed Administrator with the will aforesaid who gave bond and was _____ according to law. In the name of God Amen. I, Charles Barnhart of the County of Cabarrus and State of North Carolina being in common health and of sound mind and memory calling to mind that is appointed to all men to die - do make and publish the following as my last will and testament in the manner and form following to wit - 1st I give my soul to God who gave it and my body to the dirt from whence it was taken to be buried in a Christian like manner at the discretion of my friends. 2nd I give and bequeath to my wife Catherine the tract of land on which I now live and a tract adjoining Mathias Ledaker Robt Holt and others containing seventy five acres together with all my slaves and other property of every description to have and to hold during her widowed life or widowhood and at her death to be sold on a reasonable credit and the proceeds to be divided amongst my children sons and daughters, to wit Lewis, Aaron, Allison Barnhart and Leah wife of Jacob Faggart in such way as to make them equal in the distribution of my property to them and their heirs forever. 3rd I give and bequeath to my son Lewis Barnhart the tract of land on which he now lives containing Eighty three acres more or less and known as the Waggonar tract to him and his heirs forever, and value the same to two hundred and fifty dollars 4th I give and bequeath to my Son Aaron Barnhart the tract of land on which he now lives and containing fifty three acres more or less - to him and his heirs forever at two hundred and fifty dollars and I have but a life estate in the land I direct that in case my wife Catherine should die before me that my children Lewis, Allison & Leah execute a quit claim to him for the same and on failure to execute to him a letter for the same within twelve months after my decease that they pay to him one hundred in cash each of them or their heirs. 5th I give and bequeath to my son Alison Barnhart two hundred dollars which I have already paid him and for which I have his receipt. 6th I give and bequeath to my daughter Leah Faggart one hundred and thirty Dollars cash lent her and other articles furnished as stated on account and receipts in my papers for cash already paid her husband. 7th I hereby revoke all other wills and testaments by me made or uttered and declare this to be my last will and testament whereof I have hereunto set my hand and seal this 28th Apl 1845.
