CABARRUS COUNTY, NC - WILLS - Mary Polly Cline Barnhardt, 28 Jan 1871 --------------¤¤¤¤¤¤-------------- Last Will and Testament of Mary Polly Cline Barnhardt State of North Carolina In Probate Court Cabarrus County: A Script or paper writing purporting to be the last will and Testament of Polly Barnhart, dec'd is exhibited in open court and offered for probate in in the following words and figures to wit: In the name of God Amen. I Polly Barnhart of the County of Cabarrus and State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and Testament - First. That my Executor shall provide for my body a decent burial and pay for funeral expenses owing out of the moneys that may first come into his hands as a part of my estate. I give and bequeath to my daughter Jemima Octavia Cress Sixteen acres of land known as the File Land to be laid of by my son Benton Barnhart whereon he shall Say but Shall adjoin the land where she now lives to have and to hold to her and her heirs in fee simple forever. I give and bequeath to my youngest Son Benton Barnhart all the remaining part of my land to have and to hold to him and his heirs in fee simple forever. I give and bequeath to my daughter Julian Barnhart one Linen Table Cloth. I give and bequeath to my daughter Amanda C. M. Goodman one White Counterpane I give and bequeath to my daughter Jemima Octavia Cress one White Counterpane. I give and bequeath to my son George W Barnhart one quilt but to remain in Benton's care till called for by him. I give and bequeath to my son David C. Barnhart one Bed. I give and bequeath to my son Benton Barnhart all the remainder of my beds and beding which shall be of the first choice, I also give to my son Benton all the remaining part of my estate to have and to hold forever. And I do hereby Constitute and appoint my Trusty Son Benton Barnhart my lawful Executor to all intents and purposes to execute this my last Will and Testament according to the true intent and meaning of the Same and every part and every clause thereof hereby revoking and declaring utterly void all other wills and Testaments by me made heretofore in witness whereof I the said Polly Barnhart do hereunto set my hand and Seal this 28th day of January 1871. Test J M Suther, W N Suther Polly (her X mark) Barnhart (Seal) State of North Carolina, Cabarrus County: In Probate Court 19 August 1871 On this 19th day of August a Script or paper writing purporting to be the last will and Testament of Polly Barnhart is exhibited in Court and offered for Probate and James M. Suther one of the subscribing witnesses to said paper writing comes into court, is duly Sworn and Swears that he saw the said Polly Barnhart execute the said paper writing by making her mark to the same, that said affiant witnessed the said paper writing in their presence and at the request of the said Polly Barnhart - and affiant further Swears that at the time the said Polly Barnhart executed the said paper writing she was of a Sound and disposing mind and memory and that the said Polly Barnhart is since dead. Suther the other witness to the said paper writing comes into Court and duly Sworn who Swears that the said Polly Barnhart acknowledged to him her execution of the said paper writing declaring to him at the same time it was her last will and testament That affiant Swears further that he witnessed said paper writing at the request and in the presence of said Polly Barnhart and that she was at the time of a Sound and disposing mind and memory.
