Faggart, Elizabeth - 1843 - Cabarrus County, NC - Wills Submitted for use in the USGenWeb Project Archives by Dan Manship The last will and testament of Elizabeth Faggart was produced in open court and offered for probate and the executors thereof duly proven by the oathes of [illegible*] and Solomon Faggart the subscribing [illegible] thereto and ordered to be registered which last will and testament is in the following words and figures to wit. In the name of God Amen. I Elizabeth Faggart of the County of Cabarrus and state of North Carolina being of sound mind and disposing memory, but knowing that it has been appointed for all persons once to die do make constitute and ordain this paper writing to be my last will and testament to wit. In the first place I wish my body to be buried in a decent and Christian like manner at the discretion of my executors hereinafter mentioned and as to the worldly substance wherewith it has pleased almighty God to help me, my will is First I give and bequeath to my son Jacob F. Faggart one horse called Starters, [?] my clock, one bed and its miscellany furniture for the house, my walnut table, two chairs best quality. Secondly my will is that all my wearing apparel be divided out among my daughters living in North Carolina [illegible] and shows alike to be divided by them. Thirdly my will is that all the residue of my property of every description be sold by my executors and the proceeds of the sale and the proceeds of any debts due me after paying my just debts, and funeral expenses be divided among my children share and share alike and it is also understood that in the division my son Valentine Faggart is indebted to me at this time two hundred and seventy two dollars in notes and judgements and this amount [illegible] two hundred and seventy two dollars shall be discounted and drawn from his divide- if his share amounts be much - then the notes and judgements amounting as aforesaid shall be considered his full share and shall not [illegible] after this day. And it is further understood that in the division aforesaid that the bodily heirs of my children shall draw their fathers or their mothers share where they are now dead or may hereafter die as the case may be so that all my children or their bodily heirs as [illegible] shall have in this division share and share alike the children taking the share of their father or mother that may be dead. Fourthly my will is that my grand daughters daughter of Solomon Bost and Emilia Bost viz Milly, Catharine, Sally and Susan Bost have their mothers division of my wearing apparel - to be divided equally among them share and share alike. Fifthly I hereby constitute nominate and appoint my son Jacob F. Faggart and my nephew Solomon Faggart the executor of this my last will and testament and hereby revoke all other wills by me made or intended in testimony whereof I have hereunto set my hand and offered my seal this seventh day of June A.D. 1843.
