Cabarrus County, NC - Will of John Hagler, 1811 John Hagler Last Will & Testament Probated July Session 1811 Entered on M D V No. 3 page 294 In the Names of God Amen I John Hagler Senr of the state of North Carolina and County of Cabarrus being weak in body but perctly sound in mind and memory Do make and Ordai this my Last will and Testament and do utterly Revoke and Disanul all other wills by me made & first I will and Disire that my body be Decently buried in a Christian manner and my soul I give to God who gave it Secondly Item. I give to my wife Caty Hagler two cows choice out of my stock and one mare chois out of my stock of horses; and one Negro wench Named Agye [and her increase] and two Negro boys Named jim & Sam; and I will and disire that if my wife should think proper She is at Liberty to sell the said Negros and Equally devide the money between all my heirs Lawfuly begotten of her body, and the youse of the plantation I now live on and all the household & chiching Furniture ith the plantation Tools to her During her Lifetime or widowhood and at her Decece or Marage to be Equally Devided between all my heirs males & females Item I give to my three sons Lenard Hagler & Jacob Hagler & Charles Hagler the Land and plantation as I now Live on, aftger my wifes Deceace to be Equally Devided between them; and the Remaining part of my Stock not and property not yet mentioned to be sold and Equaly Devided between all my (Heirs in Witness-interlined) and I do Constitute ordain and appoint Jacob Love and John Hagler Junr my Executors to this my last will and Testament In Witness wherof I have sit my hand and Seale this forth Day of October one thousand Eight hundred & Eight Sind in presents of Jas Love Joseph Howell Johannes Hagler (Sealed) The ward and her increases _________ befor assigned Comments: This particular John Hagler was a cripple who had a son named John who in 1795 married Mary "Polly" Love d/o James Allison Love who was in partnership in developing the famous Reed Gold Mine in Cabarrus County. John the cripple Hagler was the son of the immigrant (from whom I descend) named Johannes (John) Hagler. As I recall his surname on his will was spelled Haygler or Hayglar. The estate of cripple John Hagler didn`t survive the court house fire of 1876. But the will and estate settlement of my immigrant fourth great grandfather (John the cripple's father) did and they are in the State Archives. My third great grandfather was Phillip and he was a half brother to John. John was a cripple and according to The Osborne Diary he was a wagon maker and it was common for him to provide shelter and a meal for travelers when night caught them before going across Rocky River at Haglers Ford, in what was Mecklenburg that in 1792 became Cabarrus County. Cripple John and his brother Jacob were the only descendants of their father mentioned in his will which was written May 26, 1771 and is somewhat strange because he was the father of nine. Since John the cripple's father - ol' John died before May 1772, the will was sent to the Archives from Mecklenburg County.
