This file was contributed for use in the North Carolina USGenWeb Archives by: Sybil Viehweg Sybil@Viehweg.org ============================================================================ Will of Robert Hope Senior Nov. 5, 1804 In the name of _____ Amen, this the fifth day of Nov. the year of our Lord, 1804, I, Robert Hope Senior, of Cabarrus County and the state of North Carolina, being in a sick and weak state of body but through divine mercy, of sound mind and memory, and being apprehensive that my dissolution may be drawing nigh, do hereby make and ordain this my last will and testament, in the manner and norm following viz: First I recommend my soul to Almighty God who gave it and my body to the earth to be interred n a decent and Christian-like manner at the discretion of my executors, and as touching such worldly estate wherewith it has pleased God to bless me in this life, I give and dispose in the following manner viz: All my just debts and funeral expenses I allow to be fully discharged since it may be convenient by money raised from my estate. To Catherine Hope my beloved wife, I give and bequeath during her natural life the part of the plantation on which I now dwell lying on ye west side of Clerk's Creek except 20 or 30 acres on the South side adjoining Dr. Harris' line, also one negro women named Bet and her son Joe and daughters Hanna and Bets, all of whom she is to have the use and service of during life as aforesaid. Also 3 horse creatures viz: Phoenix, Nell and Tips, and one-half of all my cow creatures after taking two of them for beef; also all my stock of hogs, and all of my sheep and all of the poultry and all of my grain of every kind on hand or in the ground, and all of my hay and other forage, also all of my farming utensils. Also all of my household and kitchen furniture, and wagon and gears and stage wagon with its gears, and all my wearing apparel except my best suit. Also two hundred pounds of sugar and twenty-five pounds of coffee and her side saddle and bridle and also fifty dollars in money to have or to dispose of as she pleases, all excepting the land and negroes aforesaid. To my son James Hope, after what I have already given him, my best suit of clothes I give to him. To my daughter Margaret Alexander, I bequeath and confirm to tell her all the property which she has already had from me. To my son Abner Hope I give and bequeath on hundred acres of land situated on the east side of the land whereon I now dwell, to be divided off to him by a line beginning at a black oak sapling on ye east bank of Clerks Creek along the Red Bank, running thence to a w.o. near John Gilmer's meadow, thence running with his line in such a manner as to take in the improvements thereon made by Ezekiel Wright and the spring and enclose on hundred acres of land. Also four acres of my best meadow land adjoining the land of Robert Allison, deceased, and also land for a sufficient road to said meadow, also a roand horse which he has claimed already with the saddle and bridle. Also a good bed and its furniture and also all the timber which I bought belonging to the old meeting house, which land and premises and property I give to him and his heirs and assigns forever. To my son Allison Hope I give and bequeath all that tract of land which I purchased from James Daugherty to him, his heirs and assigns forever. Also a mare and colt which he has claimed and his saddle and bridle. Also a smith anvil, vise, and bellows. To Catherine Crawford, my daughter, I give and bequeath and confirm all the property of ever kind which she has already had and received from me. To my son Thomas Hope I give and bequeath all my said smith tools and also the young horse which he has hitherto claimed with the saddle and bridle, and also six hundred silver dollars. To my son Robert Hope II I give and bequeath my house and lot which I have in Concord, allowing my executors to have the upper and lower flooring done and a good chimney built to same, and also a horse, saddle and bridle. Also two hundred dollars and two hundred against he comes of age. To my son John Hope I give and bequeath all the remainder of my old tract of land whereon I dwell. I say, remaining after the aforesaid division to my son Abner lying east of Clerks Creek and twenty or thirty acres of land on the western side of Clerks Creek adjoining Dr. Harris' line to him, his heirs and assigns forever. Also a horse and saddle amounting to ninety dollars in value against he comes of age in law. To my son Levi Hope I give and bequeath all that aforesaid part of plantation whereon I now live after his mother deceased which is mention to her, and also my clock at her decease, all to him his heirs and assigns forever. I do allow and then all my property which has not been already mentioned to be sold and all my debts collected in order to settle all the aforesaid legacies and debts which I am now owing, I mean also to allow my cotton machine to be sold, and if any balance is found then remaining the same I allow to be equally divided among my children as a above named. Also all my negroes mentioned as above which I leave to my wife during her life, I allow to be equally divided among my said children above named as soon as may be convenient after he decease. I do hereby ordain constitute and appoint my sons, James Hope and Abner Hope and my wife Catherine Hope my sole executors and excutrix of this my last will and testament, disallowing all my former wills by me in any wise made. I say ratifying and confirming this and none other to be my last will and testament the day and year above mentioned.
