I, Samuel Huie of the county of Cabarrus Town of Concord and State of North Carolina being advanced to a considerable age, and for several years past in a declining state of health, altho at this time in a reasonable state of sound mind and memory do call to recollection that it is ordained by the Supreme being, for all men to die, do constitute, make, and ordain this my last will and testament, in manner and form following to wit:-- Item--Firstly--Commend my soul to the Author of my existence who gave it not doubting but I shall receive the same at the General Resurrection. And as for such worldly estate as it hath pleased God to bless me with, I dispose of in the following manner. Item--Secondly. It is my will that my funeral expenses and just debts be paid. Item--Thirdly. It is my will that a part of my land lying next the road leading from my house towards the line of Alexander F. Russell be divided in four equal shares or Lotts of equal distance in front and to extend back in my land so far as to make each of them half acre lots. The Lott of which boundary lying next to the line of Alexander F. Russell, I give to my son, Jno. G. L. Huie. The one adjoining it I give to my grandson Alphrad Huie, and the one adjoining it I give to my son, Josiah Huie, and the one adjoining it I give to my son, Silas Huie. To which Lotts, its my will that they get possession of when they arrive at the age of twenty-one years and not until then. The remaining part of my land I give to my two sons, Jno. G. L. Huie and Josiah Huie, to be equally divided between them, with a reservation of the one third of one third said land to my wife, Jane Huie, during her natural life. Item--Fourthly, I give my house and lot whereon I now life, being the lot No. 7, N.E. Square of the town of Concord, to my wife also during her natural life and after her decease to fall to my two sons, Pleasant M. Huie and Robert C. Huie, both to be equally interested in the same. Item--Fifthly. The mare saddle and bridle usually called my wife's I give to her. And the horse saddle and bridle usually called my son Josiah's I give to him. Item--Sixthly. As far as the remaining part of my estate not heretofore named, it is my will that so much thereof as may be necessary to discharge my just debts, be put to sale, and the remaining part to be entirely at the disposal of my wife. And I do hereby constitute, nominate and appoint my wife, Jane Huie, and my son, Jno. G. L. Huie, my lawful executors to this my last will and testament, ratifying and confirming this; and revoking all former wills whether verbal or written, In testimony whereof I have hereunto set my hand and seal this fifteenth day of September in the year of our Lord one thousand eight hundred and seventeen.
