CABARRAS COUNTY, NC - WILLS - David Russell, 6 Feb 1832 --------------¤¤¤¤¤¤-------------- The last will and testament of David Russell was duly proven in open court by the oaths of the subscribing witnesses Robert Purviance and John B. Smith and the executors therein named David M. Russell came into court and was qualified and _____ letters testamentary. In the name of God Amen, I David Russell of Cabarrus County and state of North Carolina being through goodness of God in a tolerable state of Health of body and of sound mind and memory do constitute this my last will and testament and I desire that it be received as such by all. Imprimis, I most humbly bequeath my soul to my maker praying his gracious acceptance through the Lord Jesus Christ. I give my body to the earth from whence it was taken, as for burial I desire it may be decent at the discretion of my executor hereafter named, unto my worldly estate and with that all my debts be punctually paid. Item, I will to my loving wife Elizabeth Russell one Negro man named Bob and one Negro woman named Lydia during her natural life or widowhood, my will further ______ the two Negroes above named be sold after the decease of my wife and the money arising from the sale of said sale goes to equally divided among my ten children. I will to my wife seventy acres of my land lying on the waters of the ______creek and joining the lands of Solomon Cress including the house wherein I now live with all the other buildings and _____power to take rail timber and firewood off the balance of my lands at her pleasure during her natural life. Item, I will to my wife two of my horses with her riding saddle and bridle, also one plough and one pair of _____ three head of milk ______, five head of hogs, her to have her choice. Also all my household and kitchen furniture, one bed and furniture and one desk? Excepted her part of my stock and all the household and kitchen furniture to her forever. Item, one hundred dollars in the hands of executor hereinafter named to be paid out on interest for the use of my wife in case she should need it. I will and bequeath to my son James S. Russell a tract of land in Mecklenburg county on the waters of G(oose?) Creek and joining the lands of Robert Russell and one hundred dollars in money to him and his heirs forever. I will to my son Robert Russell one hundred dollars in money. Item, I will to my daughter Jenny Corzine one Negro woman named Dice with her two children together with all the issue she may have to her and the lawful heirs born of her body forever and fifty dollars in money. Item, I will and bequeath to Jane Tucker my daughter a tract of land which James Tucker now lives on, lying on the waters of Muddy Creek also a note of two hundred dollars on the above named James Tucker and the interest and seventy five dollars in money to her and her heirs forever. Item, I will to my daughter Elizabeth Holebrooks one Negro woman named Fanny and her child together with all the issue she may have and fifty dollars in money to her and the lawful heirs born of her body forever. Item, I will to my daughter Caty White one Negro woman named Viney? With her issue and fifty dollars. I will to my daughter Mary Ann Corzine one Negro girl named Charlotte with her issue and fifty dollars in money to her and the lawful heirs of body forever. Item, I will to my daughter Rachel Gingles one Negro girl named Linda with her issue and fifty dollars in money to her and the lawful heirs of her body forever. I will and bequeath to my two sons David M. Russell and William G. Russell all my land lying on the waters of Buffaloe Creek to be equally divided between them according to quantity and quality. David M. Russell part including the house in which he now lives together with all the other buildings. William G. Russell part including that whence he now lives together with all the other buildings my wife using rights accepted during her natural life to them and their heirs forever. I will to the above named David M. Russell one hundred dollars to him and his heirs forever. Item, I will and bequeath to the above named William G. Russell one bed and niturn? One milk cow, and one hundred dollars in money. I will ten dollars apiece to every grandson. _______ for me the remainder of my Negroes and personal property not mentioned in my will I allow to be sold at public sale and all the money arising from the sale together with all the money due to me by note and all _____ I may be possessed of at the time of my decease after my debts and burial charges be paid equally among my ten children. I allow my executor hereafter named to pur a headstone to my grave the expense _______out of my personal estate and I do hereby constitute and ordain my son David M. Russell to be my _____ and sole executor of this my last will and testament and I do hereby utterly disallow, revoke and ______ all and every other testament and wills by me uttered or made and I do hereby ratify and confirm this and no other to be my last will and testament.
