Faggart, Solomon - 1837 - Cabarrus County, NC - Wills Submitted for use in the USGenWeb Project Archives by Dan Manship In the name of God Amen I Solomon Faggart of the County of Cabarrus and State of North Carolina being of sound disposing mind and memory do make and ordain and declare this my last will and testament as follows viz. First It is my will that all my just debts be paid by my Executors as speedily after my death as circumstances of my estate will permit. Second It is my will that my beloved Wife Sophia shall have one negro woman or girl of her choice out of my negroes which she shall hold during her natural life or widowhood Third It is my will that after my death my wife Sophia shall have her years allowance appointed to her and have her dower in the lands laid off to her as hereinafter directed Fourth I will to my Grand daughter Sunda [?] Sophia two hundred dollars to be paid over to a good and faithful Guardian who shall be selected and appointed by the Justices of the County Court of Cabarrus County which payment shall be made on or before the expiration of ten years after my death the guardian so appointed to hold the same at interest the same as guardians now hold the [illegible] for the sole use of said Sunda Sophia until she arrives at the age of twenty one years or till twelve months after she may have a child such child being living at the time in that event the money together with the interest to be paid over to her for the use of herself and offspring but in the event that she dies before she arrives at the age of twenty one having no child as aforementioned then and in that event the said Guardian shall pay the whole of the money and interest less his Commission back to my sons that may be living at the time and to the heirs of them that may die before that time according to the law regulating descent of property Fifth It is my will that after charging each one of my children with the respective amounts as charged by me on my [illegible] dedicating said charges from each ones respective shares that my personal property not otherwise disposed of be sold my money and personal effects of every description be divided equally viz. among my wife Sophia my sons William R. Faggart, George E. Faggart, Elias F. Faggart, Henry G. Faggart, Daniel C. Faggart, Paul A. Faggart and John C. Faggart and my daughters Margaret Adaline Bost and Emilia Elizabeth [illegible] Sixth The above distribution is to be made after all my other bequest is taken out of my Estate Seventh It is my will that immediately after my death that my Executors shall select three intelligent and disinterested freeholders within the County of Cabarrus to lay off and allot to my wife Sophia one years allowance for the maintenance of herself and family out of my estate and that the said Commissioners shall be governed in all respects by the same rules as are proscribed by law for the government of Commissioners appointed by court to lay off such allowances in cases of intestacy Eighth It is further my will that my Executors shall select three intelligent and disinterested freeholders within the County of Cabarrus to lay off by metes and bounds to my wife Sophia one third part of all my lands which I may [illegible] and possessed of which Commissioners shall be governed in all respects by the same rules that are proscribed by law for the government of Jurors in laying off widows dowers by an order of court and shall report in writing under their hands and seals to the succeeding term of the County Court of Cabarrus County and all the expenses incurred for laying off the lands aforesaid and also laying off the years provisions for my wife and family shall be paid by me Executors out of my estate and the land as laid off to my wife Sophia she shall hold during her natural life or widowhood Ninth It is my will that my Executors after my death as soon thereafter as may be practicable shall select five intelligent and disinterested freeholders unconnected with the parties either by blood or marriage who shall divide and make partition of all the lands of which I may [illegible] and possessed of between and among my nine children hereinafter names as equally and impartially as they can do being governed by the same rules of law as now govern Commissioners for making partition of land in North Carolina among [illegible] in cases of intestacy and that they report their proceedings under their hands and seals to the succeeding County Court of Cabarrus County and I do hereby will I divide all my lands that I may [illegible] and possessed of at the time of my death to my following named children viz. William Ritz Faggart, Margaret Adaline intermarria with Matthias J. Bost, George Ephraim Faggart, Elias Franklin Faggart, Amelia Elizabeth intermarria with [illegible], Henry Graber Faggart, Daniel Chalmers Faggart, Paul Alexander Faggart, John Caldwell Faggart to be held by them in severally after the allotment and partition above directed shall have been made to them and their heirs forever the expenses for dividing the land as above directed shall be paid by my above named children in equal proportions Tenth It is my will that after the death or marriage of my wife Sophia that the negro woman or girl herein before willed to her together with the increase of such negro shall be sold by my Executors and the proceeds divided as my personal is directed to be divided in the fifth section of the foregoing will Eleventh I do hereby constitute and appoint my three sons viz. William R. Faggart, George E. Faggart and Elias F.
