Mary Sims, Exparte Petition for years Allowance In Probate Court State of North Carolina} Court of Probate Cabarrus County} October 29, 1868 To the Judge of said Court: The Petition of Mary Sims widow of Nathanial Sims respectfully showeth unto your Honor that her huband died intestate in the County aforesaid, the first of September 1868, and that letters of administration on his estate have been granted to N. A. Kirkpatrick today. Your Petition further showeth, that she desires to have her Year's Support out of the estate of her said husband, alloted to her according to law, and to that end she prays your Honor to appoint one Justice of the Peace and threee freeholders, unconnected with her, to view the said estate and t allot and set apart to her so much of the crop, stock, and provisions belonging thereto, as may be adquate to the support of herself and family for one year; and if there shall not be a sufficiency on hand to afford such allowance, then to assess the deficiency in money, and report their proceedings under their hands and seal to this court. And your Petitioner will every pray. Morris a Justice of the peace for the County of Cabarrus and John H. Davis, Thomas H. McClelland and Alford F. Gerton, be, and they are hereby appointed Commissioners to lay off and allot to Mary Sims, one years allowance for the maintenace and support of herself and family for one year out of the personal estate of Nathaneal Sims decd according to the provisions of the General Assembly in such case made and provided. And that they report their proceeding in the premises in writing under their hands and Seals to this Court within ninety days from the date hereof. Witness my hand and seal of my office John A.
