CALDWELL COUNTY, NC - WILLS - William Connolly, 15 Jun 1852 ----¤¤¤¤---- This is a transcription of the will of William Connolly who died 1/8/1859. The will was made on 6/15/1852 in Caldwell County. The copy was obtained from the North Carolina Archives in Raleigh. Will I William Connolly of the County of Caldwell and state of North Carolina, being of sound mind and memory, but considering the uncertainty of my Earthly existence, do make and declare this my last will and testament in manner and form following, that is to say: First ­ That my executors (here after named) shall provide for my body a decent burial, suitable to the wishes of my relations and friends, and pay all funeral expenses together with my just debts however and to whomsoever due, out of the money that may first come into the hands as a part or parcel of my estate. Item ­ It is my will, as it has not been my fortune to acquire much property while living, that my dear wife, if she survive me, be well provided for, and in order that this my desire be carried out, I do will and bequeath to her all my property both real and personal including all my lands, tenaments (sic) and improvements, with all my house hold and kitchen furniture, farming tools, and every thing else whatsoever shall be pertaining to me at my decease, if she shall, so elect; and further more, that she may be well attended to, it is my will that my dear son Russel shall be and is hereby requested and appointed by me to take the over sight of the farm and farming tools, and stock of every kind, and use the same so as to best to carry out the purpose here in intended; and furthermore, that, to compensate him for carrying out this my will and desire, he be allowed the use of the farm and all the apertainances (sic) there to during the natural life of my sad wife, and, after providing her with every thing necessary for her support and comfort, to detain all other procids (sic) arising from the cultivation of said lands and pertenaments(?) to be his forever, in fee simple for such case as may devlolve upon him, without rent or claims. It is also my will that my aforenamed son Russel be allowed ten dollars in addition to the above named allowance as a further indemnity for services already mentioned, to be paid out of any money arising from the sales of property belonging to my estate or hereafter provided for, for each year devoted to the services abovementioned; but, if my wife shall not survive me I desire that my property be sold by public auction both real and personal, and be divided among each of my children share and share alike after making fair calculations and balances of all property that has been received by each of them previous to my death, and I do herby invest in my executors full power to dispose of my real estate in fee simple, or for a term of years, or otherwise in as ful and large a manner in every respect, and could my self do, if living. Item ­ I desire that the children of my son George, Deceased, may receive all and as much as he would have been Entitled to, had he been living; and my will is, and I do appoint my son J. D. Connolly Guardian of the aforenamed children, and in case of his death or refusal, I appoint my son Russel Conly instead thereof, and it is my will that the money descending to the above named children be loaned out at lawful interest their Guardian taking bond and approved security for the returns of the same as the said children arrive to the age of twenty one or marry as the case may be, share and share alike principle and interest as they arrive to the aforesaid age. Item ­ I will and bequeath to my grandson H Thomas H. Smith, one horse saddle bridle and blanket the whole not to exceed fifty dollars, which may be bought out of any money’s coming into the hands of my executors as selected by them from among the stock belong to my estate at my decease, as it many seem to them best; furthermore it is my will that my grandson Thomas H. Smith above mentioned receive all and as much as his mother my daughter Clasinda Smith would have been Entitled to, had she been living, provided, however, he shall not stay with me or his grandmother to the age of twenty one, it is not my desire that he have a horse. Item ­ Having made a complete schedule of all property and articles given to my children as they severally left me, a coppy (sic) of which I shall keep, and desire the same to be given to my executors, that they may be the better abled to do equal justice to all parties. Item ­ If my wife survive me it is my will, that, after her decease all property remaining after giving her a decent burial, shall be dispersed of in the same manner as is here in directed, except that it is my desire that my grand T. H. Smith have the horse saddle bridle and blanket already mentioned at the age of twenty one. And I do hereby make and ordain my much esteemed sons J. D. Connolly and R. Connolly Executors of this my last will and testament; in witness, where of, I, William Connolly the testator, have to this my will, written on one sheet of paper, set my hand and seal, this June 25th in the year of our Lord one thousand eight hundred and fifty-two. Item ­ To my daughter Margaret Jones, household and and (sic) kitchen furniture, stock valued at $58.50. Item ­ To my son George W. Connolly; horse, saddle, bridle and blanket, household and kitchen furniture stock and co; valued at $77.50. Item ­ To my daughter Clasinda Smith household and kitchen furniture, stock, valued at $80.125. Item ­ To my son W. G. Connolly, one horse, saddle, bridle and blanket valued at $57.75. Item ­ To my son, J. W. Connolly, one beast, household and kitchen furniture, provisions stocks, valued at $79.75. Item ­ To my son, R Connolly, one beast, household and kitchen furniture, stocks and co. valued at $62.50. Item ­ To my daughter, Julia A. Blair household and kitchen furniture stock valued at $70.375. Item ­ To my son, M. A. Connolly one horse valued at $35.00. This schedule written on one half sheet of paper, I design as an appendage to my last will and testament and I also desire the same to be given to my executors, or an assistant to their in carrying out the same, and doing equal justice to all parties; in witness whereof I, the testator have set my hand and seal.
