Bk. C, p. 96 Sept 1th, 1724 Sept. 10, 1724 North Carolina To all to whom these Presents shall come I, Richard CANADAY of the Precinct of Carteret in the County of Bath and Province of North Carolina, planter send Greeting. Know Ye that I the said Richard CANDIDAY for and in consideration of the sum of thirty pounds current money of the Province to me in hand well and truly paid by John ROBERTS of the same Taylor the receipt where I do hereby acknowledge and myself therewith fully contented satisfied and paid and thereof and of every part and parcel thereof doth hereby acquit exonerate and discharge the said John ROBERTS his heirs Executors, Administrators and assigns hath granted bargained sold aliened ensued conveyed assigned and set over unto the said John ROBERTS hie heirs his Executors, Administrators and assigns all that tract or parcel of Land containing by estimation four and twenty acres be the same more or less which said tract of Land and premises are situate lying and being on the W side of North River in the said Precinct of Carteret beginning at a pine Peter WARDENS corner tree then N seventeen, E Sixty Pole to a pine thence Seventy Three E eighty pole to a pine then S Forty W fifty three pole to a pine thence to the first station which said Land was purchased and patented by the said Richard CANADY and by him sold and assigned over unto the said John ROBERTS as by the said Patent bearing date the ninth day of March Anno Dom 1717/18 and now upon record in the Secretarys Office of this Government relation thereunto being had doth and may more fully and at large appear. To have and to hold the aforesaid tract or parcel of Land containing four and twenty acres with all and singular the privileges and appurtenance unto the same belonging or anywise appertaining unto him the said John ROBERTS his heirs and assigns forever to his and their only proper use benefit and behoof forever. And I the said Richard CANIDAY do for myself my heirs Executors and Administrators covenant, grant, promise and agree to and with the said John ROBERTS his heirs and assigns in manner and form following (viz)that the said John ROBERTS his heirs and assigns shall and lawfully may from time to time and at all times forever hereafter by force and virtue of these Presents peaceably and quietly have hold use occupy possess and enjoy the pre bargained premises and every part and parcel thereof free and clear and freely and clearly acquitted and discharged of and from all former and other gifts grants grants bargains sales jointures dowers entails reversions remainders executions extents and all other charges and encumbrances whatsoever the annual quite rents due tot he Lords Proprietors for the same only excepted. And I the said Richard CANADAY do for myself my heirs Executors and Administrators covenant promise and agree to and with the said John ROBERTS his heirs and assigns that I the said Richard CANDY my heirs Executors and Administrators the pre bargained premises and appurtenances against all and all manner of persons whatsoever lawfully claiming or to claim the same by from or under me the said Richard CANADAY my heirs Executors or Administrators or from any other person or persons whatsoever by any ways means or procurements shall and will warrant and forever defend by these presents.
