Bk. C, p. 93 Sept 1, 1724 North Carolina To all to whom these presents shall come, I Richard CANADY of the Precinct of Carteret in the County of Bath and Province of North Carolina send Greeting. Know Ye that I the said Richard CANADY for and in consideration of the sum of fifty pounds current money of this Province to me in hand well and truly paid by John ROBERTS of the Precinct County and Province aforesaid Taylor the receipt where of I do hereby acknowledge and myself therewith fully intended satisfied and paid and thereof and of every part and parcel thereof doth hereby acquit exonerate and discharge the said John ROBERTS his heirs Executors, Administrators and assigns hath granted bargained sold aliened assessed conveyed & confirmed and by these presents doth fully freely and absolutely give grant bargain sell alien — convey confirm assign and set over unto the said John ROBERTS all that capital messuage house out houses garden on hand and tract of land to the same belonging containing by estimation twenty severn acres be the same more or less which said messuage land and premises are situate lying and being on the E side of North River and part of a large tract of land purchased and patented by Enoch WARD of the said Precinct of Carteret, Esqr. as by the said patent bearing date, 1st day of November Anno Dom. 1719 and deed of conveyance for the land from ye, sd. Enoch WARD to ye. sd. Rich’d CANADY bearing date the twentieth day of June Anno Dom 1721 now upon record in the Precinct of Craven relation? there unto being had doth and may more fully and at large appear beginning at a Live Oake standing on the side of a Hammock near the river from thence N 30 E 80 pole to the back line to a pine from thence W 13 N to a pine by the river from thence down the river 114 pole to the beginning. To have and to hold the said messuage land and premises containing twenty severn acres above said with all and singular the privileges and appurtenances to the same belonging or anywise appertaining unto him the said John ROBERTS his heirs and assigned forever to his and their only proper use benefit and behoof for ever. And the said Richard CANADAY do for myself my heirs Executors and Administrators covenant grant promise and agree to and with the said John ROBERTS his heirs and assigns in manner and form following (viz) that he the said John ROBERTS his heirs and assigned shall and Lawfully may from time to time and at all times forever thereafter by force and virtue of the presents and enjoy the pre bargained premises and every part and parcel thereof free and clear and freely and clearly acquitted and discharged of and from all former and other gifts grants bargain sale jointures dowers entails revisions remainders executions extents and all other charges and encumbrances whatsoever the annual quit rents due to the Lords Proprietors for the same only excepted. And I the said Richard CANADAY do for myself my heirs Executors and Administrators covenant promise and agree to and with the said John ROBERTS his heirs and assigns that I the said Richard CANADAY my heirs Executors and Administrators the pre bargained premises and appurtenances unto the said John ROBERTS his heirs and assigned against all and all manner of persons whatsoever lawfully claiming or to claim the same by from or under me the said Richard CANADAY my heirs Executors or Administrators & or from any other person or persons whatsoever by anyways means or procurement shall and will warrant and forever more defend by these presents.
