State of North Carolina Carteret County Will of William Kuhn, January 7, 1914 I, William Kuhn, of the County of Carteret, State aforesaid, being of sound mind and memory, but considering the uncertainty of my earthly existence, and being desirous of directing how my property shall be disposed of after my death, do make, declare and publish this my last will and testament, in manner and form following, that is to say: First: My executor, hereinafter named, shall give my body a decent burial and pay my funeral expenses, together with all my just debts out of the first moneys that may come into his hands as a part of my estate, and shall have my body buried on my farm by the side of the grave of the late Edward W. Pelletier; and my said executor is hereby directed to place over my remains a plain tombstone on which shall be inscribed the date of my birth (February 24th, 1849) and the date of my death. Second: It is my will and desire, and I hereby direct that my said executor shall place over the grave of the late Edward W. Pelletier a tombstone similar to the one to be placed over my remains, and pay for the same out of my estate. Third: I give and bequeath to Ferdinand Hatchel (Mulatto), present address 111 East Washington Street, Greensboro, North Carolina, the sum of one hundred ($100.00) Dollars in cash, in all. Fourth: I give and bequeath to John H. Gillette, son of Mrs. D.S. Holland, of Silverdale, NC., my gold watch and chain and the sum of one hundred ($100.00) Dollars in cash. Fifth: I give and bequeath to Eva Gillette, daughter of Mrs. D.S. Holland, of Silverdale, N.C., my “Regina” music box, and disc records complete, and the sum of one Hundred ($100.00) Dollars, in cash. Sixth: I give and bequeath to Ethel Gillette, daughter of Solomon Gillette, of Maysville, N.C., the sum of one Hundred ($100.00) Dollars in cash. Seventh: I give and bequeath to my friend Robert S. Weeks, of Maysville, N.C., my gold signet ring with monogram W.K. Eighth: I give and bequeath to my friend J. Walter Pelletier, of Stella, N.C., my gold Signet ring with plain “K.” Ninth: I give and bequeath to Mrs. Julia F. Godwin, the sum of one Hundred ($100.00) Dollars in cash. Tenth: I give and bequeath to Hillard A. Mattocks, (colored) a faithful employee, the sum of Fifty ($50.00) Dollars in cash. Eleventh: I give and bequeath to Mrs. Mary S. Young, wife of J.H. Young, the sum of Five Hundred ($500.00) Dollars in cash, and the choice of one of my horses; and I also give to her any articles of household and kitchen furniture, or any other articles of personal property in the house where I live, other than those specified above, as she may choose and select the same. Twelfth: I give and devise to James H. Young, now residing with me, my farm at Kuhns, N.C., to have and to hold the same to him, his heirs and assigns forever. Thirteenth: All the residue of my estate, after the payment of debts and legacies, I bequeath to James H. Young. Fourteenth: Should the said James H. Young die before me, then all the bequests and devises made to him shall go to John H. Gillette, son of Mrs. D.S. Holland and her late husband, John H. Gillette, all of Silverdale, Onslow County, N.C. Should the said John H. Gillette die before me, then all the bequests and devises to him shall go to his mother, Mrs. David S. Holland, of Silverdale, Onslow County, N.C. Fifteenth: In case of the deaeth before me of anyone of the other legatees under my vice, the amounts bequeathed to them shall be distributed pro rata among all the surviving legatees mentioned in his will, except Ferdinand Hatchel. Sixteenth: I hereby Constitute and appoint my friend J. Walter Pelletier, of Stella, N.C., my lawful executor to execute this my last will and testament, according to the true intent and meaning of the same, giving him authority also, as such executor to receive all moneys in bank standing in my name or in the name of William Kuhn, Agent; and I hereby revoke and declare void all other wills and testaments by me heretofore made. In witness whereof I, the said William Kuhn, do hereunto set my hand and seal this 7th day of January, 1914. William Kuhn, (seal) Signed, sealed, published and declared by William Kuhn to be his last will and testament in the presense of us, who at his request and in his presence and in the presence of each other do subscribe our names and witnesses thereto. Pelletier State of North Carolina, Carteret County In the Superior Court A paper purporting to be the last Will and Testament of William Kuhn, deceased, is exhibited before me, the undersigned, Clerk of the Superior Court for said County, by J. Walter Pelletier, the executor therein mentioned, and the due execution thereof by the said William Kuhn, by the oath and examination of W.N. Mattocks and J.R. Pelletier the subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of William Kuhn; that the said William Kuhn in the presence of this deponent subscribed his name at the end of said paper-writing, which is now shown as aforesaid, and which bears date of the 7th day of January, 1914. And the deponent further saith, that the said William Kuhn the testator aforesaid, did at the time of subscribing his name as aforesaid-declare the said paper writing so subscribed by him and exhibited to be his last Will and Testament, and this deponent did thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith, that at the same time when the said testator subscribed his name to the said last Will as aforesaid, and at the time of the deponents’ subscribing his name as an attesting witness thereto, as aforesaid, the said William Kuhn was of sound mind and memory, of full age to execute a Will, and was not under any restraint, to the knowledge, information, or belief of this deponent: And further these deponents say not. W.N. Mattocks J.R. Pelletier Severally sworn and subscribed, this 9th day of March, 1914, before me. T.C. Wade Clerk Superior Court. North Carolina, Carteret County In the Superior Court. It is therefore considered and adjudged by the Court that the said paper-writing and every part thereof is the last Will and Testament of William Kuhn deceased.
