Will of Benjamin Small of Cartret Co. NC; 
Written: 30 January 1751
Probate: 23 May 1752


The 30 of ye Eleventh Mo: Called Jeneary 1751. I Benjamin Small of Cartret in 
the Provance of North Carolina being sick But of Perfect memory Thanks be to 
God and calling to mind the Morality of my body.  Do make and ordain this my 
last Will and Testament in Manner and Form following.
Printiplely and first of all I recommend my Sold to God and my Body to be 
decently buried at the Discretion of Executors hereafter Name as to my 
temperal and Worldly Estate that it has pleased God to bless me with my Will 
and Desvie is That first of all my just Debts and Funeral Charges be paid.  
Item: I give to my loving Wife Meriam Small the your of my Plantation and all 
the Improvement belonging thereunto with One Hundred Acres of Land & Twenty 
Joining tot he Same Dureing har Natural Life.  I likewise to har all that 
Part of my Estate That was her property before I marryed her and that that 
was given given har by her Father sence I also gave her two cows & calves, 
Bed & Furneture- 1 Tea Kettle, grate putter Dish, Small Still, Hand Mill, 
grate brass Cittle all the earthen with the Corn & Meat.  Item: I give to my 
son Benjamin Small one bed tick that he fild his self and furneture, I give 
him my Deque to make.  The Feathers I likewise give to my son Benjamin that 
Plantation I bought of David Baly and is convayed to him by a deed baring 
date 1751 to him forEver.  Item: I give to my Son Jonas Small one feather bed 
& furneture, two cows & calves, grate Chest one Iron Pott.  I Likewise give 
to my son Jonas One Hundred Acres of Land Joyning to my son Benjamin be the 
same more or less convayed to him by a deed dated 1751. to him & his Heirs 
forEver.  Item: I give to my son Amos Small one feather Bed & Furneture, Cow 
& Calve Uew & Lamb & the Cobart? likewise I give to my son Amos One Hundred 
of Land Joyning to Thomas Jessops Land to be laid out by a line from ajon by 
the Side of the Grate Mark and so up to to the Head Line of my one land to 
him and His Heirs forEver. Item: I Give to my son John Knite Small one 
Featherbed and Furneture 2 cows & Calves I likwise give to my son John Knite 
my Mama Plantation after my aforesaid wifes decease to him and his Heirs 
forEver.  Item: I give to my daughter Sarah Jessop one sile skin Trunk beside 
what I gave har at her Marrag which was One Feather Bed, two puter Dishes & 3 
plats and sence she moved to Core Sound I gave her fore cows and calves two 
uew & Lambs.  Item: I give the use of my Water Mill to my Wife & four Sons 
Equally Divided to my wife & four Sons Benjamin, Jonas, Amos & John Knight 
Small.  I Further Nominate appoint and constitute my Wife to be my Executrix 
& my son Benjamin to be my Executer of this my Last Will and Testament to Se 
the Same Law fully Executed. In Witness whereof I have set my Hand & fixed my 
Seal in the presence of

Carteret County March Court 1752.  
At a Court of Common Pleas began & held at Beaufort Town on the first Tues. in 
March 1752.  Present his Majesty's Justices, These are to certify that Henry 
Stanton made affirmation that he saw Benjamin Small; sign, seal, Publish & 
Declare that Within Instrument of Writing to be his Last Will and Testament 
and that he also saw Patience Bull Evidence that Same and that Miriam Small 
Executrix therein appointed Qualified himself as the Law Directs
