Will for Catawba County: The Will of Ephriam Kale - Dated January 23, 1853 and probated in the July Session 1853 I, Ephraim Kale of the County of Catawba and State of North Carolina, being of sound mind and memory but considering the uncertainty of my earthy existence, do make and publish this my last will and testament, in manner and form, that is to say: First --- That my executor hereinafter named shall provide a decent burial suitable to the wishes of my relatives and friends and pay all furneral expenses together with my just debts. Howsoever and whatsoever owing and of the moneys that may first come into his hands as part of or parcel of my estate. Item 1 ---- I give and devise to my beloved wife Ruanna all of my tract of land where I now live to have and to hold to her the said Ruanna, for and during the remainder of her natural life as widowhood, and at her death or marriage, I will that my executor sell all the above named land and that the proceeds thereof be disposed of as here in after mentioned. Item 2 --- I give and bequeath to my said beloved wife Ruanna, my nergro woman named Phebe and all of the children that she may have after this date and all of my house hold and kitchen furniture, and three head of cattle her choice, and two horse beast Duck and Nell, and my old wagon, and four pair of gears, two blind bridles, and two collars, and twelve sheep her choice, twenty hogs her choice, all the farming untensils except the hand axe and cross cut saw, all the crop and grain that may be on hand at my death. Also all of the provisions of every kind, on hand at my death and all the fowl of every kind at my death is to be left to my wife Ruanna during her natural life as widowhood, and at her death or marriage, I instruct my executer to sell all of the unconsumed parts of my bequests. The proceeds there of to be disposed of as here in after instrusted. Item 3 -- I give and bequeath to my son Henderson Kale, one gray mare, saddle, a cow, one calf, one falling axe, all of which he has received. I value the same to him $110.00. Item 4 -- I give and bequeath to my daughter Nancy C. Kale, one side saddle which she has received. Ivalue the same to her at $10.00. I will that Nancy have $100.00 dollars more, which makes $110.00. I will that Nancy get one bed. Item 5 -- I give and bequeath to my son Silas Kale, one horse called Riot, one saddle, one falling axe, a pair of traces, a blind brindle, a bark band, a cow and calf all of which he has received. I value the same to him at $113.25 dollars. I will that Silas pay back to my estate $3.25 . Item 6 -- I will and bequeath to my daughter Sally Kale, $110.00 and a bed. Item 7 -- I give and bequeath to my son Luther Kale, one gray filly called Pigeon,one cow and calf, one pair of traces, pair of harness, bark band, plow stack, single tree and cleaves, two plow irons, a sow and pigs, falling axe, all of which he has received I value $103.25. I will that Luther get $6.75 more. Item 8 -- I give and bequeath to my daughter Mary Elizabeth Kale, $110.00 and a bed. Item 9 -- I give and bequeath to my son Polser Kale, $110.00. Item 10 -- I will and bequeath to my son Isaac Noah Kale, a claybank colt valued at $50.00 and will Noah to get $60.00 more. Item 11-- I will and bequeath to my son Pickney Kale, one Rifle gun and $100.00 more. Item 12 -- I will and bequeath to my daughter Margaret Susan Kale $110.00 and a bed. Item 13 -- My will and desire is that my nergro boys Tom and Alexander and two little girls Pat and Uariah be sold at or soon after my death with the residue of my estate after taking out the devises and legacies above mentioned and the debts owing to me collected and if there should be any surplus over and above the payments of debts and expenses and legacies that such surplus shall be equally advanced and paid over to all my children to be equally provision,share and share alike and lastly I do hereto constitute and appoint my friend Joseph M. Lowrance, my lawful executor to all entents and purposes, to execute this my last will and testament assuring to the true entent and meaning of the same and every part and clause there of, here by revoking and declaring utterly void all other wills and testaments by me, here to fore made. In witness whereof, I said Ephraim Kale do hereto set my hand and seal this 23 day of January 1853.
