I, ANDREW HOLLER, being of sound mind but considering the uncertainty of life and the certainty of death, do this day make and publish this my last Will and testament in manner and form that is to say as follows: FIRST ITEM: It is my will that my body be decently buried and all my just debts be paid. SECOND ITEM: I will my real estate as follows: 1st I will to my son ELIS (ELLIOTT) a lot of land known as Lot # 1 as a plat will show. (12 acres and 31 poles - dated 3/29/1897)- Book 55 page 440 2nd I will to my son, GILBERT HOLLER, lot # 2 as will show by plat marked # 2 (21 acres, 2 rods and 73/4 poles - dated 3/2/1897) 3rd I will to the Heirs of my daughter, AMANDA HOLLER HUFFMAN, lot # 3, as a plat will show. (38 acres, 1 rod, and 4 poles and in another tract, 5 acres, 3 rods, and 24 poles - dated 3/2/1897) - book 55 page 441 4th I will to my son, DANIEL, lot # 4 as shown on a plat (46 acres, 3 rods, 31/2 poles. -dated 3/33/1897) -book 51 page 562-563 ** 5th I will to my son, LEMUEL, lot # 5 as shown on plat (35 acres and 31 poles and in another tract 4 acres, 1 rod and 11 poles) - book 53 page 493 6th I will to my son, MARCUS lot # 6 as shown on plat (71/2 acres given to MARCUS 3/3/1896. (by the terms of the Will this same tract was included in the 80 acres, 3 rods and 28 poles dated 3/8/1897) 7th I will to my daughter, CATHERINE HOLLER SMYRE and her heirs lot # 7, as will show by plat marked # 7, to them and their heirs forever. (30 acres and 8 poles and in another tract 5 acres and 28 poles) - dated 3/2/1897 - book 53 page 500-501 *** THIRD ITEM: It is my will that the remainder of my estate not already willed or otherwise disposed of be sold by my Executor hereinafter named and all my debts paid, the balance, if any, to be equally divided between all my heirs. FOURTH ITEM: I hereby appoint my son, M.M. HOLLER as my Executor of this my last Will and Testament. In witness whereof I sign my name and affix my seal. Signed this 19th day of December, 1896 in the presence of C.W. HERMAN and M.L. HERMAN. This Will was sworn and subscribed to the 30th day of May 1898 before J.W. Rocket, Clerk of Superior Court, Catawba County, NC" ************************************************************************** On 8/29/1899 DANIEL SYLVANUS HOLLER sold to WILL P. SIGMON 77/8 acres of his land for $95. On 1/1/1918, DANIEL HOLLER sold the remaining 38 1/8 acres to his daughter MAUDE V. HOLLER PEARSON and her husband ROMIE HALL PEARSON, and to his youngest daughter, EVA OLA HOLLER. (*** Andrew's son ADLAI (ADLEY) was not willed any land. On 4/14/1871 Adlai bought from his father 115 acres paying the sume of $330 for it ) - book 8 page 121
