The document may be used by any activity or project within the USGenWeb so long as it contains the following statement: "Contributed to the USGenWeb Archives by: Nancy Rattz nrattz@alltel.net " ======================================================================= North Carolina Chatham County Know All men by these presents that we the undersigned being the only heirs of Martha Bobbitt lately deceased in the County of Chatham, did on the 17th day of January 1880, meet together upon the premises herein after described and by mutual and common consents all and every- of us being of age, did proceed to divide as nearly as possible according to the terms of the last Will and Testament of the said Martha Bobbitt, all the real estate belonging to her the said Martha Bobbitt at the date of her death. At which time and place after full consideration and a survey of the primises we agreed upon and affected a division as follows; To Wit; To A. Hartwell H. Bobbitt, as his portion of the said lands is allotted and assigned that part of same as is described within the boundaries following; Beginning at a Stake Harringtons Corner on west side of Lick Creek runs East 102 poles to a Sweet gum, then S14 E45 * poles to a stake, then East 57* poles to a stake, then S62 poles to a stake, then S76* W20 poles to a stake, then S41* poles to a stake, then S19* W8 poles to a stake, then S11* W 50* poles to a stake Thomas Bobbitt Corner, then East with his line 55 poles to a stake, then north 208 poles to a stake, then East 14 poles to a White Oak on the branch, then down the branch to Hinsleys Corner, then North with his line 16 poles to a stake, then West 157 poles to creek, then down the creek to a Sweet-Gum, then West crossing the creek 42 poles to Harringtons line, then South 52 poles to the first station, containing 97 acres. To Susanna Mansfield, wife of Sion T. Mansfield, as her portion of the said lands is assigned and set apart lots or parcels embraced within the boundaries as following; To Wit; Beginning at a Sweet gum on east side of creek, corner of Lot# 1 runs East 144 poles to a stake in Hinsleys line then S26 poles to a stake Corner of Lot# 1, then West to the creek, then down the course of the same to the first station containing 26 acres. Also another lot, bounded as follows, to Wit; Beginning at a White Oak, corner of lot# 1 runs West 14 poles to a stake, then S 208 poles to a stake in Browns line, then East 44 poles to a stake, then North 180 poles to a branch, then down the branch to the first station containing 54 acres. To Amanda Yarbrough, wife of Joseph R. Yarbrough as her portion of said lands is assigned and set apart the lots as parcels embraced within the boundaries following; To Wit; Beginning at a Sweet gum, corner of lot# 2 on the creek, runs East 145 poles to Hinsleys line, then North with his line 9 poles to his corner, then N69 W108 poles to the creek, then down the creek to the first station, containing Twenty five (25) acres. Also another lot, bounded as follows to wit; Beginning at a stake Hinsleys corner, runs N63* W33 poles to head of a drain, then down the drain to a stake corner of lot # 3, then south 180 poles to a stake in Browns line, then East with his line 50 poles to a stake his corner, then North 150 poles to first station. Containing 51 acres And we A.H.H. Bobbitt, Susanna Mansfield & Sion T. Mansfield, in consideration of conveyances and releases hereinafter made and executed to us and infurther considerations of the Sum of five dollars, to each of us in hand paid, have bargain & sold released and quite claimed, and by these presents, do bargain, sell release quite claim and convey unto Amanda Yarbrough, her heirs and assigns, all our right, title, interest claim, demand and estate in and to the lands embraced within the boundries set out in description of lot# 4 & lot# 5. To have and to hold the above released premises, unto her the said Amanda Yarbrough, her heirs and assigns to her and their only use and behoof in fee simple forever. And we A.H.H. Bobbitt, Amanda Yarbrough and Joseph R. Yarbrough in consideration of conveyances and releases herein made and executed to us and in furtherconsideration of five dollars to each of us paid, have bargained, sold, released and quit claimed, and by these presents do bargain, sell, release quit claim and convey, unto Susanna Mansfield her heirs and assign all our right title interest claim demand and estate, in and to the lands embraced within the description of lot# 2 & lot# 3. To have and to hold the above released premises last described unto her the said Susanna Mansfield her heirs and assigns to her and their only use and behoof in fee simple forever. And we Sion T. Mansfield Susanna Mansfield Joseph R. Yarbrough, and Amanda Yarbrough in consideration of conveyances and releases hereinbefore made and executed to us, and infurther consideration of five dollars to cash of us paid, have bargained sold released, & quit claimed and by these presents do bargain sell release quit claim and convey unto A. Hartwell H. Bobbitt his heirs and assigns all our right title interest claim demand and estate in and to the lands embraced with the descriptions of the boundries of lot# 1, to have and to hold the primises last & so embel unto to him the said A. Hartwell H. Bobbitt his heirs and assigns to his and theirs only use in fee simple forever. Mansfield (seal) Chatham County, Be it remembered that on this the 31th day of May 1883, before the undersigned an acting Justice of the Peace in and for Chatham County personally came A.H.H. Bopbbitt Joseph R. Yarbrough and Annie his wife, and Sion T. Mansfield and Susanna, his wife, persons named as covenantios and grantors in forgoing instrumants of covenants agreement and conveyance and they did each for themselves acknowledges that they did execute the same for the purposes therein expressed. Ofherupon Amanda Yarbrough wife of Jos R. Yarbrough and Susanna Mansfield wife of Sion T. Mansfield being by me examined privately separate and apart from them said husbands touching their voluntary execution after said interment, they do say each for herself, that they executed the same voluntarily of their own free will and accord, and without any fear Compulsion or other undue influence of their said husbands and that they do still voluntarily assent thereto, so say they both each for herself, witness my hand and seal the day month and year last above written.
