D. Thomas, of Chatham County, and State of North Carolina, of the first part, to Josiah S. Thomas, of Chatham County, and State of North Carolina, of the second part, WITNESSETH: THAT said J. D. Thomas in consideration of Forty five dollars to him paid by said Josiah S. Thomas the receipt of which is hereby acknowledged, hath bargained, and sold, and by these presents do bargain, sell and convey to said Josiah S. Thomas and his heirs, all the right, title, interest and estate of the party of the first part in and to a tract or parcel of land in Chatham County, State of North Carolina, adjoining the lands of the heirs of Joseph Thomas, Dec'd, it being lot No. Six as was devided and allotted to the Sd J. D. THomas seven & 1/2 acres out of the lands that belonged to the estate of his father, the said Joseph Thomas Dec'D. TO HAVE AND TO HOLD the aforesaid tract or parcel of land and all privileges and appurtenances thereto belonging, to the said Josiah S. Thomas, his heirs and assigns, to their only use and behoof forever. And the said J. D. Thomas covenant that he is seized of said premises in fee, and hath right to convey the same in fee-simple; that the same are free and clear from all incumbrances and that he will warrant and defend the said title to the same against the claims of all persons, whatsoever, to the said Josiah S. Thomas, & his heirs. In testimony whereof, the said J. D. Thomas, has hereunto set his hand and seal, the (?) day and year above written. J. D. (X - his mark) Thomas (Seal) Attest: R. J. Yates I, W.
