Original Wills, 1771-1964, p 196, 197, 198 Know all men by these presents that I, BENJAMIN MARSHALL of Chatham County and State of North Carolina being in perfect health and sound in memory but knowing the mortality of my body and that it is appointed for all men once to die do this the twenty eighth day of the third month 1812 make and ordain this my last will and testament and as touching such worldly affairs as it hath pleased the lord to bless me with, I bequeath will and dispose of in manner following, that is to say, first I do will and bequeath unto my beloved wife CHARITY MARSHALL one feather bed and furniture, one cow and calf and woman's saddle to her and her heirs forever. I also do allow her five pounds in cash. I do likewise allow her her maintenance with her children of the plantation while she remains my widow and no longer. I do also will and bequeath to my daughter, SARAH GIFFORD twenty shillings; likewise to my daughter HANNAH WHEELER one cow and woman's saddle and twenty shillinsg; also I will and bequeath to my daughter REBECCA MARSHILL five pounds - and to my daughter RUTH MARSHILL one bed and furniture, one cow and saddle and twenty shillings; also REHAB I do will one bed and furniture one cow and saddle and twenty shillings, likewise to my daughter MARY MARSHALL one bed and furniture, one cow and saddle and twenty shillings. I do will and bequeath to my son ISAAC MARSHALL one horse creature saddle and bridle; likewise I do will and bequeath to my son HIRAM MARSHALL one horse creature saddle and bridle. I also will and bequeath the plantation that I now live on to my two sons ISAAC and HIRAM when they come of the age of twenty-one and they do maintain my widow and small children. And the plantation that is now bought and not paid for, if they think best to sell it and let it pay for itself they may do so but if otherways my sons ISAAC and HIRAM to have that also reasonable divided between them when paid for. And all the remainder of my property to be for the use of the house and plantation while my wife remains my widow but at the end of her widowhood to be equally divided between my two sons before mentioned. Nevertheless if my wife should prove to be with child and it to live if it be a male child then it is my will that my other two sons shall pay to the said child one hundred dollars each of them, but if a female child to be made equal to the other females. I do ordain and appoint my friend JESSE HINSHAW and son ISAAC my whole and sole executors and trustees of this my last will and testament to act in my stead; and do strictly charge them to do according as it is here set forth; and I do hereby acknowledge this and no other to be my last will and testament.
