CHATHAM COUNTY, NC - WILLS - William Burns, 27 Feb 1860 --------------¤¤¤¤¤¤-------------- Will - William Burns - Will Book D, pg. 94 Feb. 1860 no Probate date I William Burns of the County of Chatham State of North Carolina being of sound mind and memory but considering the uncertainty of my earthly existence do make and declare this my last will and testament in manner and form following. First, I hereby give and resign and commit my boddy and soul unto God. That He will do with and by them as will best promote my happiness and his Glory amen. Item 2 that my executrix and executor here after named shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with all my just debts , howsoever and to whomsoever owing out of the monies that may come into hand as a part and parcel of my Estate. Item 3rd, I give and devise to each of my daughters one bed and furniture, one cow and calf to be delivered at their marriage or my wife's death. I also give to each of my daughters and my son William H. Burns my carriage and Still to have and hold for their own use and benefit as long as they remain living together or if one thinks it best he or she may sell his or her interest or all Sell and divide the money equal but let it be by the consent of all whether of age or not. I also give to my two oldest daughters, Patsy and Hannah twelve dollars each out of my estate to be paid over to them as soon as is convenient, it being money that I consider that I justly owe them. Item 4th it is my will and desire that my son William H. Burns have as much As twelve months schooling also one bed and furniture and one cow and calf or the value thereof which I consider worth thirty five dollars also twelve dollars ( ? ) the lawfull interest from the date of this will intill he becomes the age of twenty one at which time he shall be entitled to receive all that I have given him. Item 5th I received four hundred dollars from my son Silas Burns deceased estate which I wish to be divided equally between each of my daughters and Son William H. Burns it is now loaned to William M. Burns and if need be I desire my trusty friend Stephen Gilmore see to it that that money shall be continued in safe hands until my Son William becomes of age and that each one Shall receive the Interest annually as they have been doing. Item 6th I give and bequeath to my beloved wife all the residue of my estate after taking out the desires and legacies above mentioned. Consisting of lands houses hogs cattle sheep poultry household and kitchen furniture in time every thing I profess to have and to hold and use as she may think will tend to her happiness and to the benefit of her children that survive(?) and wish to live with her so long as she lives on during her widowhood. It is furthermore my will and desire in case my beloved wife should at any time of her life be likely to suffer for want of sustenance or necessaries or not having enough to (?) to pay pay off the above legacies I say in that case to sell off my lands twenty or thirty acres at the North end in case that she should need more sell as much at the South east corner which would be in shape Something like a triangle. Again in case my wife should die before my son William becomes of Age I say in that case provided as many as three or more of my Daughters Should remain Should remain unmarried and without a home and desire to remain at the old place in that case it is my will and desire that the two oldest of my Daughters wishing to remain Shall possess and hold with all the privileges which have been herebefore given unto my wife untill William H my youngest son becomes of age and then if there be any property besides my houses and a portion of my land worth selling and dividing it is my will for it to be sold and every things settled as it should be at that time that is after collecting and paying all just debts and and ( ?) that the overplus if any be equally divided and paid over to each and every one of my children excepting my son James against whom I hold a Note for fifteen dollars when he has settled said note and the interest there upon he can come in as an equal Share with the rest of my children. Item 7th as I feel for my Daughters and wish to provide for them as well as I can I say in case there yet should remain as many as three or more of my Daughters unmarried and without a home and wishes to remain at the old place in that case it is my will and desire that my houses and a portion or all of my land? for my Daughters and son William as long as many as three of them may remain?. As my son William will be of age at this time if living as I wish him to take care and attend to his sisters whether he should be married or not I therefore leave it to my Son William's children whether my executors shall sell and how much of my land with the other property that may be sold at that time. It is my will and desire that my son William have the privilege of clearing and using it for his benefit clear of any rent also his sisters so long as three of them remain unmarried and wish to live at the Same old place. but when ever they wish to separate it is then that my will and desire is that the land and premises be sold and equally divided as here before named. And lastly I do hereby constitute and appoint my trusty friend (?) Stephen Gilmore and my Daughter Esperan my lawful executor and Executrix to all intents and purposes to execute this my last will and Testament according to the true intent and meaning of the Same and every part and clause there of hereby revoking and declaring utterly void all other wills and testaments by me heretofore made.
