CHATHAM COUNTY, NC - WILLS - James Hackney, 4 Nov 1863 --------------¤¤¤¤¤¤-------------- Will of James Hackney November 4, 1863 North Carolina State Archives, Chatham County Wills Call No. 022.801.12 Know all men by the present, that I James Hackney of the County of Chatham and state of North Carolina being of sound mind and memory. But of infirm health do make and declare this my last will and testament in manner and form following that is to say, First, that my executor hereafter named shall provided for my body a decent burial and pay all funeral expenses together with my just debts, to whomever owing out of the money that may first come into his hands as a part and parcel of my estate. Item 2 give and devise to my beloved wife three hundred and twenty nine acre of land where on we now live with all houses and improvements to have and to hold, Elizabeth Hackney during her natural life or widowhood in satisfactory form? And … in liew of her dower? And third of and in all my real estate. But in case she marry the above item will be void. Item second, I give and bequeath to my said beloved wife Elizabeth the beds and furniture one bearueau, together with all the household and kitchen furniture, seven head of cattle, twenty head of hogs, nine head of sheep, all the fowl and poultry, one …mare thirteen years old, one sorrel mare eight years old , one sorrel mare eight years old one mare colt one year old one young suckling colt, one two horse wagon, all the farming tools of every description, all the crops of every description that may be upon the plantation whereon I now live and all the provisions on hand at the time of my death. Item 3 My will and desires that at the death or marriage of my beloved wife Elizabeth, my executor shall make public sale of all by property both real and personal and when the money is collected after paying all debts and expenses, then the surplus shall be equally divided and paid over to my said wife and all my children, in equal proportion share and share alike to them or each of theirs, or their guardian as the case may be or their executors, administrators and assigns absolutely forever. And lastly, I do hereby constitute and appoint my trusty friend Robert Dorsett my lawful executor to all intents and purposes to execute this my last will and testament according to the true intent and meaning of the same and every part and clause thereof. Here by revolking and declaring utterly void all other wills and testaments by one heretofore made. The witness I the said James Hackney do hereunto set my hand and seal the 4th day of November 1863.
