CHATHAM COUNTY, NC - WILLS - Joshua W. Hackney, 21 Aug 1890 --------------¤¤¤¤¤¤-------------- Will of Joshua W. Hackney August 21, 1890 North Carolina State Archives, Chatham County Wills, Call No. 022.801.12 In the name of God, Amen, I Joshua W. Hackney of the County of Chatham and State of North Carolina, being of sound and desposing mind and memory, but knowing the uncertainty of human life, do make, publish and declare this my last will and testament in manner and form as follows: Item 1st I give and devise to my wife Harriet H. Hackney for and during the term of her natural life the tract of land on which I now reside known as the Home Place ("Except that tract of land lying on the East side of said Home Place and known as the Joshua Williams tract") together with all the stock of all kinds, all the crops, all the household and kitchen furniture, all the farming utensils, wagons, buggies and carriages that may be in or upon said home place. Item 2nd after paying all my just debts I devise and bequeath all the rest and residue of my estate of every kind whether real, personnel or mixed to the following children and grandchildren, namely on sixth part of my son J. J. Hackney, one sixth part of my son M. S. Hackney, one sixth part to my son E. C. Hackney, one sixth to my daughter Anna Foushee, one Sixth part to my grand children, Bettie Hill Ward to Robert S. Ward (Jointly) and one sixth part of my grand son James Hackney, (son of L. M. Hackney deceased). Provided that my son M.S. Hackney shall pay the sum of eighty dollars out of his part to the other heirs and my daughter Anna Foushee shall pay the sum of one hundred and fifty dollars to the other heirs out of her part. And provided further, that if any of my children or grandchildren shall die without a lawful heir of their body, then their part of my estate herin bequeathed shall go to my other lawful heirs. This devise and bequest is to include all the property devised and bequeathed to my wife Harriet by item one of this will after the determination of her life estate therein. Item 3rd I monninate (nominate?) constitute and appoint my son J. J. Hackney, exector of this my last will and testament. Griffith Wittnesses To provide for my son Floyd Thaxton Hackney born since the making of the foregoing will, I hereby make the following codicil to be taken as a part of my will - to wit I give and devise unto my said son Floyd Thaxton Hackney that portion of my homestead tract of land bounded as follows, beginning at Dr. E. L. Wards corner on the Fayettville road running south with said road to Hackneys Cross roads, then with the Raleigh road east to Riddles Corner, then North with Riddles line to Wards Corner, thence with said Wards line to the 1st station supposed to contain one hundred and fifty acres, be the same more or less, but this devise is not to disturb the estate for life in these lands given to my wife Harriet in my will above written. I also give to my said son Floyd Thaxton the sum of one hundres and fifty dollars for educational purposes and further I wish him the said Floyd Thaxton to share this division of my estate as provided in item 2ne of my will above written equally with my other children and grand-children, so that the said Floyd shall receive one seventh part of any estate not specifically devised in my said will or this codicil and each of those mentioned in said item 2nd shall receive a one seventh part instead of a one sixth part as thereto provided.
