CHATHAM COUNTY, NC - WILLS - James H. Harman, 24 Feb 1891 ----¤¤¤¤---- State of North Carolina Chatham County I, James H. Harman of said County and State do hereby make and publish this my last will and testament as follows: First of all I commit my soul into the hands of the Almighty God, hoping through the Merits of Christ my Savior to inherit eternal life. Item I. Whereas I have heretofore given to my two sons Joseph C. and John E. Harman the land whereon they now reside, and whereas said land is more than their proper share of my real estate, now therefore I do now ratify and confirm said gift of the said land to my two said sons and I do require that for such excess of valuation they and each one of them shall pay into the hands of my Executor hereinafter named the sum of Two Hundred dollars for the benefit of my other heirs as hereinafter to be stated, or they may pay the said sum or any part thereof to me during my life and receive credit therefor, and they or either of them shall not be compelled to pay the said sum of two hundred dollars for each of them before the expiration of two years after my death but interest shall be charged on the portion unpaid after one year from my death. Item II. Whereas I am desirous of securing a home for my grand children, heirs of my deceased daughter Sarah Griffin, therefore I give to my grand son James Griffin as trustee for all his brothers and sisters including himself, forty acres of land including my dwelling and out houses to be for the use of the said children, viz: James Griffin, Isaac N. Griffin, Ida Griffin, Thomas Griffin, Robert Griffin, Emerly Griffin, William Griffin, Walter Griffin, and Mary wife of Isaac Clark, or as many of them as shall remain and occupy the same as a home for no others, until the youngest of them shall become twenty one years of age, at which time the said forty acres shall become the property of the said nine grand children or those that shall be living at that time, in fee, absolutely and forever, I desire that the said acres be surveyed off, marking the lines and making a map of the same, so as to be for the best interest of the said grand childred and the other heirs interested in my real estate, and I hereby appoint R.E.Clegg, Surveyor, and John B. Clegg and Thomas Burns to lay off said land and to have their report and the map recorded in the Registers office. In case of failure on the part of either one or more of the above to attend to this business it shall be the duty of my Executor to appoint others to fill the vacancy and their decision shall be final. Item III. I give all the remainder of my real estate, to be divided equally between my other children, viz, William P. Harman, the children of Emerly Womble, deceased, the children of Eliza Clark, deceased, and Mary, wife of Marion Perry, this land to either partitioned off in lots or sold and the proceeds divided, as may be determined upon, by a majority of those directly interested, who are twenty one years old. Provided however that William P. Harman is to account for the 35 acres heretofore given him, which I value at One Hundred and thirty two dollars and the heirs of Eliza Clark, deceased shall account for ninety seven dollars and fifty cents, the amount due me by their father, J.J. Clark, deceased, and must come out of their share of the land or money derived therefrom. Item IV. It is my will that all my personal property be sold at auction for cash except my large red chest, which I give my grand daughter Emerly Griffin. Item V. It is my will that what ever is left of my estate after paying all my just debts and cost of administration shall be equally divided between all my children, the legal heirs of any one of my children who is dead, to represent their parent, except that Jos. C. Harman and John E. Harman are not to receive any thing from the sale of land or of the four hundred dollars that they are to pay on excess of valuation for the reason they have all the land they are entitled to. Item VI. I nominate and appoint my friend William J. Womble to be my sole and only Executor to this my Will and Testament.
