CHATHAM COUNTY, NC - WILLS - Susan H. Marsh, 23 Aug 1843 ----¤¤¤¤---- (Chatham Co. Will Book C, Page 278) Will of Susan H. Marsh Dated 23 Aug. 1843 - Probated Nov. Term 1850 In the name of God, Amen, I, Susan H. Marsh, of the county of Chatham, & state of North Carolina, being of sound, disposing mind & memory, do make & appoint this my last will and testament in manner & form as followeth. My will first, is that all my just debts be paid. The balance that remains, I dispose of as follows. First, I give & bequeath unto my son John R. Marsh, the tract of land that I purchased of Fitts, which he is to receive at its valuation. I also give & bequeath to him, out of the money that may arise for the sale of my perishable property, to make him equal with the rest of (my) children. I give & bequeath unto my daughter Ann D. Brooks, wife of Tyrell Brooks, one third part of all my estate, that is to say, as much money as will make her equal with the rest of my children. My will further is that my Executor hereafter named, is to retain in his hands for the following purpose, one tract of land adjoining Avil Brooks' tract of land, is to be valued, and he is also to retain in his hands of the proceeds of sale of my estate, a sum sufficient to make it equal to one third of my estate, & my Executor is hereby directed & empowered to pay over to Susan W. Brooks, wife of Avil Brooks, such sum of the above named, as she may need for her support. My said Executor is hereby empowered to let the said Susan W. Brooks cultivate the above mentioned lands, or rent them out for her use. My will further is that at the death of the said Susan W. Brooks, he is to equally divide the above tract of land & money, if any remains, equally between the issue of the said Susan W. Brooks, wife of Avil Brooks'. My will further is that all my property be sold on nine months credit, when the money is collected and The lands valued & added together, and my daughter Ann D. Brooks, wife of Tyrell Brooks, one third part of the whole sum, John R. Marsh is to receive of the money to make his land & money worth one third of my estate. And my Executor is to retain in his hands for the use of Susan W. Brooks, money sufficient, when added to the valuation of the land, he is to retain equal to one third of the value of my estate, that is to say, John R. Marsh, one third; Ann D. Brooks, one third; & my Executor retain one third part for the use of Susan W. Brooks. I nominate & appoint my son John R. Marsh, Executor to this my last will & testament, & revoking all former will by me made. In witness whereof Susan H. Marsh, hereunto set her hand and seal this 23rd day August 1843.
