Weaver sweaver@mindspring.com ==================================================================== Chatham County, November Term 1850 In the name of God Amen, I, Gabriel Utley being of sound mind and understanding and impressed with the great uncertainty of life & the certainty of death and being desirous to dispose of my temporal affairs so that after my death no contention may arise relative to the same that I Gabriel Utley of the County and State aforesaid do make ordain publish and declare this my last will & testament revoking all other wills by me heretofore made. First. I bequeath my body to the dust whence it came & my soul to God who gave it hoping for a happy immortality through the atoning merits of our Lord Jesus Christ the Savior of the world my desire is that my body be buried in a neat and christian like manner. Secondly That all my just debts be paid out of the proceeds of such property as shall hereinafter direct to be sold. Thirdly. I loan unto my wife Lucy Utley during her natural life or widowhood the following property (to wit) slave Mary & child Any also my plantation with the exception of one hundred as hereinafter named with such farming tools as she may see fit (?) two bed steads & covering one side board & cupboard candle stand crokery & glass ware of every description with all the kitchen furniture. 2nd choice table & all the chairs and all other articles that may be needed for housekeeping also one bay horse and gray horse cart & steers, fifty barrels of corn fifteen hundred pounds of pork one sow & pigs and ten dry hogs first choice six head of sheep 100 lb coffee 100 # sugar three milch cows & calfs thirty bushels wheat seven blade stacks. Fourthly: I give to my beloved son Jacob Utley to make him equal to my other two sons one hundred acres of land adjoining the lands of of William Boylan to be valued & layed of by any three disinterested men to at least to be in valuation equal to the land I gave to my son Asa Utley. Fifthly. I give & bequeath unto my daughter Elizabeth Utley one negro girl slave Mariah. Sixthly I give & bequeath unto my daughter Mary Utley one slave by the name of Emely. 7th. I give & bequeath unto my daughter Ap--- Utley one slave by the name of Martha. 8th. I give & bequeath unto my daughter Emeline Utley one slave Sally having heretofore given Paris money & Asa Utley a lot of land I think equal in valuation to the property named to my other children therefore I have bequeathed to them only an equal part of my remaining property hereinafter named to be sold to wit the residue of my crop & stock waggon & other articles not disposed of in in my will with slaves Mirty, Chery & Charles with all debts due me either by note or account with cash on hand shall be equally divided share & share alike among all my living after paying my just debts of every kind & at the death of my beloved wife Lucy the land given her shall be equally divided between Jacob Utley & Asa Utley my beloved sons The residue of my estate to be sold by my Executor & equally divided among all my children share & share alike my children are not to account to one another for any thing I may have given them heretofore. Lastly I appoint my beloved son Jacob Utley my whole & sole Executor to this my last will & testament and direct that no security be required of him for the faithful execution and discharge of the trust hereby reposed in him. In testamony whereof I have this the 6th day of September one thousand eight hundred and fifty hereunto set my hand & affixed my seal. In the presence of Thomas Ragland Gabriel Utley J. W. Buchanan
