I, George Williams Senr. of the County of Chatham and State of North Carolina being weak in body but of perfect mind and memory thanks be to Almighty God do make and ordain this my last will and Testament in the manner following, viz. 1st I lend to my beloved wife Delpha Williams that part of the tract of land on which I now live lying on the North side of the Indian Branch also the one fourth part of my grist mill also my beds and furniture one beffett one leaf table the chairs in the house two work horses three cows and calves two sows and pigs also a negro man by the name of Allen and a boy by the name of Macklin one woman by the name of Ednica and one girl by the name of Kiddy and one by the name of Phebe also that part of the cleared land that I purchased of George Barbee lying on the West side of the road also one years provisions all of the above mentioned property I lend to her her natural life or widowhood and after her decd or intermarriage that part of my grist mill to return to Marmaduke Williams and that part of the George Barbee tract which I lent to her to return to John Williams the the residue after her dec'd to be sold and divided equally amongst William Williams, Richd Williams, Elizabeth Moore, Martha Stone, Henry Williams, John Williams the lawful heirs of George Williams Jr. viz Eliza, David P. John D. and Polly E. Williams and Marmaduke Williams. 2nd I give my son John Williams the tract of (land) I purchased of George Barbee and half of my mills and sale (or sate) also one negro man by the name of Major. 3rd I give to my son Marmaduke Williams the land I purchased of Simon Williams and also the tract I purchased of Henry Kelly and the one half of saw mill and one fourth of part of my grist mill & site and one negro man by the name of Merross. The above mentioned property which I have given to John and Marmaduke Williams is to and their heirs forever. It is my will that Wm. Williams, Richd Williams, Elizabeth Moore Patsey Stone and Henry Williams keep what I have given them before. It is also my will that Wm Williams shall receive out of my estate the sum of one hundred and twenty dollars it being about the amount which he had to pay Chris Barbee as security to George Williams it was done by my request, as to the residue of my estate after paying all my just debts It is my will that it should be divided amongst Wm Williams Richd Williams Elizabeth Moore Patsey Stone Henry Williams John Williams Marmaduke Williams and the lawful heirs of George Williams Junr. viz Eliza David P. John D and Polly E. Williams who are to be considered equal to one Legatee. And I moreover appoint John Williams Henry Williams and William Williams Executors to this my last will and testament. "To the worshipful Justices of the County Court, the Petition of Jeptha Horton, Administrator of William Williams, John Horton, Exr. of Richard Williams, Elizabeth Moore, William Stone, John Stone, Francis Stone (something is scratched out names mother Martha) _____Winberry (known) & wife Jane & ____John Hatley & wife Sally, which said William, John, Francis, Jane & Sally are the children & legal representation (__) distributee of Martha Stone deceased (of Eliza, David P, John D. & Polly E. Williams, Children of George Williams, Jun. NOTE: A LINE WAS DRAWN THROUGH THE NAMES OF ELIZA, DAVID P., JOHN D., & POLLY E. WILLIAMS) and of Marmaduke Williams against Henry Williams and John Williams Executors of George Williams Sen. decd. and against Eliza Williams, David P. Williams, John D. Williams, Polly E. Williams, heirs of George Williams, Jr. humbly shows-- That the said George Williams Sen late of Chatham died in the year ____ having find made & published a last will & testament to which has been duly admitted to probate in this court and the Exn. therein warned Henry Williams & John Williams both qualified according to law your petitions shew that the testator among other things divide & bequeath to his wife Delpha Williams a certain slave by name Allen, Macklin, Anica, Kiddy & Phebe also household and kitchen furniture & horses, cows, & hogs during her natural life or widowhood & after her death that the same should be sold by the Executors and divided equally amongst "William Williams, Richard Williams, Elizabeth Moore, Martha Stone, Henry Williams, John Williams, the lawful heirs of George Williams, Jr. viz. Eliza, David P., John D. & Polly E. Williams & Marmaduke Williams. That the said testator also divided as follows: 'It is my will that Wm. Williams shall receive out of my estate the sum of one hundred & twenty dollars it being about the sum which he had to pay Chris Barbee as security to George Williams, it was done by my request.' That said testator also divided as follows, 'as to the widow of (?) after paying all my just debts it is my will that it should be divided amongst William Williams, Richard Williams, Elizabeth Moore, Patsy Stone, Henry Williams, John Williams, Marmaduke Williams and the lawful heirs of George Williams, Jr., Elizabeth P., David P., John D., & Polly E. Williams, who are to be considered as one legatee.' All which will appear by reference to said will which is hereby made a part of the petition. Your petitioners further shew that the widow of said Testator has been dead about two years--thence the Executors have sold the property left her for life, paid the debts of the testators &c. ___: & have in their hands a large sum for distribution under said will--your petitioners further shew that William Williams is dead and that Jeptha Horton is his admr. and Richard Williams is dead & that John Horton is his executor, that Martha Stone is dead & that her heirs are set forth in this petition & that Geo. Williams Jr is still alive & his children are herein correctly named among the petitioners. Now that thise Executors may (true?) & (perfect?) answer make to to these allegations & these particularly they set forth their account of sale of the property left to the widow for life, & the amount of the residue of the testator's estate after payment of debt & that they come to an account & settlement of the estate & pay over to your petitioners in the individual & respresentative characters such ________ shares & portions of the estate of said Testator as they are entitled to (respectin?) by.
