STATE OF NORTH CAROLINA    SUPERIOR COURT OF LAW           CHOWAN COUNTY
October Term, 1808

JOHN ALLEN
   vs.
ARTHUR JONES

The Complainant having filed his bill this Court, and the Defendant having 
appeared and put in his answer thereto -- and afterwards died before the said 
cause came on for hearing; and it being represented to the Court that DANIEL 
JONES, brother and heir at law of the said ARTHUR JONES, dec'd, resides out of 
State, so that process of revival cannot be personally served on him. It is 
therefore on motion of the complainant's counsel, ordered, that notice be 
given to the said DANIEL JONES, by advertisement, in the Edenton Gazette, for 
the space of two months; that unless he appears at or before the next term of 
the said Court, and be made a party defendant to the said cause, the said bill 
will be taken pro confesso against him; and the cause set for hearing on the 
bill and answer.
