The original estate papers are in a folder located in the NC State Archives in Raleigh. All court actions take place at the Chowan County Court of Pleas and Quarter Sessions, Thomas Brownrigg, Justice. This Bush/Boush family and some of its descendents from 1770 to 1947 are documented in the Bush Family Bible transcribed by Mary Lou Wolfarth which can be found online at http://files.usgwarchives.net/nc/chowan/bibles/bush01.txt. William Bush, Chowan planter, died young and intestate leaving an estate of approximately £2,000 ($4,000), a young wife and four children. The estate papers document how the wife had to sell the personal estate and shows how the negroes were divided among the heirs. It also covers a dispute about the guardianship of the orphans and the management of their estates by their mother and stepfather. The documents show the value of a wide range of items at auction in 1805, the value of slaves at the beginning of the 19th century, and the cost of upkeep of a young woman. They also illustrate the transition from British pounds to dollars over the period 1804 – 1817 after the revolution. The documents are numbered in chronological order and are referenced in the more extensive summary that follows. William Bush of Chowan County NC died intestate at the age of 34 in early December 1804 leaving a wife, Sarah Jackson Bush, 33, and four young children - William 9, John 6, Mary 4, and Gillah (Gilly) 18 months. On 11 December 1804 shortly following the death of William Bush, Sarah Bush files an Administrator Bond (Doc 1) for £1,250, with her brothers William and James Jackson as surety, to administer the estate of her former husband. She also files a petition for one year's provisions for herself and her children (Doc 2). Accordingly, John Bennett, Henry Hurdle, John Fullington & Cader Hurdle along with Thomas Brownrigg, Justice of the Court, do an allotment including 979 pounds of pork, 20 barrels of corn, and 7 gallons of peach or apple brandy. Since William Bush dies without leaving a will, the estate has to be liquidated in order to be valued and ultimately divided among his heirs. The personal estate is sold, probably at auction, on February 11, 1805 by Sarah Bush as administrator (Doc 3) and she is also the purchaser of the majority of the items of the house in which she is living including chairs, beds, a cradle, a "chister draws", as well as farm implements such as axes, plow, whip saw, barrels, etc., kitchen and table ware and livestock such as pigs, cow, horses, etc. The estate totaled £124.14.1 (also shown on Doc 20) of which the widow purchased £49.5.5. Of the remainder of the estate purchased by others, £30 is for a single mare. The sale value of the personal estate in dollars (as referenced in Doc 15) is $249.41, or about a 2 for 1 exchange rate. This is clearly a time of currency transition after the revolution, and the documents of the estate use both currencies through 1817. On March 14, 1807 an Arrest Warrant is issued for Salley Bush (Doc 2a - on same file as provision allocation) for non-payment of debt. William Bush died owing Thomas Copland £30. The case is settled on March 23rd for £12.13.8 to be levied on the good and chattels of Henry Hurdle as Administrator of the William Bush estate. On August 14, 1807 Sarah Bush, now 36, marries the same Henry Hurdle age 42. In December of that same year, along with James Jackson and John Felton as surety, he files guardian bonds of £500 each for the four Bush children. (Doc 4). The Guardian Bond basically says that he will administer their estates on their behalf and in their best interest or forfeit the bond. These bonds confirm an estimated value of the estate of £2,000. Also in December 1807, Henry Hurdle and Sarah Bush Hurdle petition for the division of the negroes of the Bush estate so that Sarah Bush Hurdle may take possession of her one-fifth share. (Doc 5). In January 1808, by order of the Court, Thomas Brownrigg (Justice), Samuel McGuire, William Felton, Job Winslow & Humphrey Ward (or any three of them) were ordered to divide the negroes of William Bush, deceased. (Doc 6) They identified 7 negroes ranging in value from $275 for Rose to $45 for Sall (Note: document is in dollars) for a total of $1,195. The Hurdles were entitled to one-fifth or $239 and this was satisfied by allocating two negroes, Amey and Aga, of $100 each and $39 in cash. There are no further documents until 1815. In June of 1815 daughter Mary, 15, passes away leaving William 20, John 17 and Gilly 13. In June 1815 William Walton files Guardianship bonds for William and John Bush of £500 each with Exum Simpson and Thomas Jones as surety. (Doc 7) There was a Treasey (Teresa) who married first Elisha Twine in 1803 and then William Walton in 1813. She was the mother of Martha Twine who marries William Bush, the orphan of William Bush referenced above, in 1827. The death of Treasey Walton on February 3, 1845 is recorded in the Bush Family Bible. So this William Walton may be the future step-father-in-law of William Bush who would be 20 at this time. Clearly he was a neighbor, but it is not clear what his interest was in assuming guardianship at this time. In September 1815 the Court orders that Thomas Brownrigg and Henry Skinner, Myles Welch and Humphrey Ward or any three be appointed to settle the accounts of Henry Hurdle, administrator of William Bush deceased. They draw up an accounting ledger of the debits and credits of the orphans, primarily relating to the board expense (including their sister Mary while she was alive) and hire revenues of their negroes from 1808 through 1815 by year (Doc 8). Skinner, Welch and Ward issued a summary of those findings (Doc 9) in an undated report to the court - probably in 1816 as the full year 1815 is included. The accounting showed that Hurdle was owed £9.5.5 while the orphans were due £30.3.6 for the period in question. In December 1815 John Felton, one of Henry Hurdle's sureties on the Guardian Bonds, files a petition to the court (Doc 10) to be relieved of his commitment. He believes he will suffer because Hurdle has "neglected and mismanaged the estate of said Orphans" and has not filed the required annual accounting to the court. In March 1816 William Walton files a petition (Doc 11) asking that the estate of William Bush be divided so that orphans William and John Bush, now under his guardianship, may gain possession of their share. On March 12th of that year Thomas Brownrigg, Ephraim Elliott, William Wright, Humphrey Ward and Henry Elliott or any four are appointed to divide the estate and "lay off to William and John their parts." This accounting deals with the six remaining negroes of the estate - the original seven, less two to the Hurdles in 1808, plus a new negro, Dick. (Doc 12) In total they are valued at $1,250 or $312.50 per orphan. The report performs this allocation among the four orphans with a combination of negroes and cash to each. But then in June 1815, before the final report, Mary Bush, one of the orphans dies. The Hurdles claim that her heirs are not only her surviving siblings and her mother, but also her two new half sisters, Nancy & Rachel Hurdle. Thus her portion must be divided further into six parts and the report proceeds to do that. William and John receive Treacy, Patt, Dick, and Tom while Gilly receives the negro, Rose. The Hurdles receive cash for their half portion (three parts of six) of Mary's estate and the negro Sall, now worth $200. In June 1816, a year after he assumed guardianship of the boys, William Walton files a Guardian Bond of £500 for Gilly Bush (Doc 13) with John Felton and William Laundes as surety. Gilly is now 13 years old. He pays the £0.16.0 due as guardian fee for John & Gilly Bush. (Doc 14) William turns 21 in November 1816. Also at the June Term 1816 J. Skinner, Exum Simpson, Richard Brownrigg and Henry Elliott are ordered to make an accounting of Henry Hurdle as Guardian for Gilly Bush and in August they file a report (Doc 15) showing that there is a balance due Gilly Bush of $191.28 after 9 ½ years of guardianship. (Note the two different currencies in the same year in the same court.) In December 1816 William Walton files a petition on behalf of William, John and Gilly Bush stating that they originally inherited an estate of approximately £2,000 from their father when they entered guardianship with Henry Hurdle. The petition is filed against the estate of Henry Hurdle, who has died intestate on May 1, 1816, and alleges mismanagement and failure to report on the parts of Sarah Bush Hurdle and Henry Hurdle. Writs of subpoena are requested for Sara Hurdle and Myles Welch, Administrator of the estate of Henry Hurdle. (Doc 16) Myles Welch answers this petition in March 1817 saying that, while he agrees that the orphans are entitled to a distribution from the estate of Henry Hurdle, he does not believe the amount to be the full £2,000 since the Hurdles provided board, schooling and clothing, and asks the court for time to determine the correct amount they are owed. (Doc 17) In April 1817 Notices to attend a hearing on May 22, 1817 are issued to Myles Welch, Sarah (Bush) Hurdle and William Walton. (Doc 18) On May 14 1817 William Walton is served three summonses on behalf of William, John and Gilly Bush (separately) to render accounts of guardianship as required by law. It does not say who initiated these summonses. The missing accounts would be for the year 1816. (Doc 19) On June 10, 1817 Henry Wills, Deputy Clerk of the Chowan County Court of Pleas and Quarter Sessions issues a Report in the Suit of William Walton, Guardian vs. Myles Welch Administrator wherein he does an accounting for the period February 11, 1807 to June 21, 1815. The report shows that the Orphans are due £213.15.6 from the Hurdle estate. (Doc 20) The final three documents in the estate file are the guardian accounts of William Walton for Gilly Bush for 1818, 1819 and 1820 (Docs 21, 22 and 23). John Bush turns 21 in October 1819. All accounts are in dollars and in each year she is owed money from the estate primarily due to the hire out of her negro, Rose, but also due to the rental of land which in combination more than cover her expenses. At this point Gilly is only 17. Did she marry? There is a major expense of $18 for a feather bed and bedstead in 1820. CAROLINA Chowan County December Term 1807 To the Worshipful the Justices of the Court of Pleas and Quarter Sessions for the County aforesaid the Petition of Henry Hurdle who has intermarried with Sarah Bush widow etc. of Wm Bush dec'd. Humbly complaineth therewith unto Your worships that your petitioner is entitled to dower in the lands of the said Wm Bush dec'd and a distribution share of the personal estate agreeable to law in such cases made and provided. Your petitioner further sheweth that the sd. Wm Bush ded'd died leaving four children viz Wm John Mary Gilley with whom your petitioner is entitled to an equal share of the personal estate of the said Wm Bush dec'd. Your petitioner also further sheweth that the sd.
