  NOTICE TO THE SUPERIOR COURT

Tyrrell County, Dec. 6th, 1808

   The Subscriber being called upon by COL. CHARLES SPRUILL concerning what he 
may know about the continuing  suit HENRY FLURY vs. CHARLES SPRUILL, now at 
issue in the Superior Court of Chowan County. -- I do certify, that the said 
cause was continued at October Term, by the Plaintiff as soon as the Judge 
announced it; and the Defendant CHARLES SPRUILL was not in Court, nor was he 
called at all. I further certify, that the said CHARLES SPRUILL requested me 
on the morning of that day to let him know when the suit was called, as he 
would be ready for trial if he got well enoought to attend, but he said he was 
so sick that the thought himself incapable of attending the Court House at 
that time, that he had taken physic the night previous.
