Will of John Abel Ware (1809 - 1881)

Know all men by these presents, that I
John Abel Ware, of the County of Cleveland
State of North Carolina, considering
the uncertainty of this life, and being of
Sound mind and memory, do make,
declare and publish this my last will
and testament
     First.  I give and bequeath unto my
beloved wife, Mary Ann, the use, improvement
and income of my dwelling House, lands and
                    and personal property
their appurtenances, situate in the County of
Cleveland State of North Carolina, to have
and to hold the same to her, for and during
her natural life.
     Second.  After the death of my beloved wife
Mary Ann, I give and bequeath to my
Son Crowder the dwelling house in
which I now live with all the out buildings
and one hundred acres of land, the
same to be laid of and Measured
by three discreet and disintere¹d Men
provided that my said son Crowder
shall Keep and Maintain my deaf-mute
daughters and my deaf-mute son
Columbus.
     The remainder of my property
personal and real to be divided
between the remainder of my children
as may be determined by law.
     In testimony whereof, I have this day,
to this my last will and testament, set my
my hand and seal.  In the year of our
Lord One thousand, Eight hundred and
Eighty-one  2nd day of March.

Signed, sealed, declared and published by the
said John Abel Ware, as and for his last
will and testament, in presence of us, who, at his
request and in his presence, and in the
presence of each other, have subscribed our
names as witnesses hereto

The foregoing paper writing pur
ported to be the last will & testament
of J.A. Ware de d, and due execution
thereof proved by the oath of
John Watterson & J W Tracy subscribing
witnesses there to.
Thereupon the said paper writing
and every part there of is
adjudged to be the last will &
testament of J A Ware and the
same is ordered to be recorded
& filed

STATE OF NORTH CAROLINA }

                                                       } ss.     In the
                                                       }  Probate Court.

                    Cleaveland   County.

     A paper purporting to be the last Will and Testament of  John A Wareś
deceased, is exhibited before me, the undersigned, Judge of Probate for said
County, by ___________ the execu_____ therein mentioned, and the due
execution thereof by the said John A Ware by the oath and examination of
John Watterson   J W Tracy the subscribing witnesses thereto: who being duly
sworn, doth depose and say, and each for himself deposeth and saith that he
is a subscribing witness to the paper writing now shown him, purporting to
be the Last Will and Testament of

John A Ware that the said John A Ware in the presence of this deponent
subscribed his name at the end of said paper writing, which is now shown as
aforesaid, and which bears the date of 2d  day of March 1881

     And the Deponent Further Saith, That the said John A Ware the testator
aforesaid, did at the time of subscribing his name as aforesaid declare the
said paper writing so subscribed by him, and exhibited to be his last Will
and Testament, and this deponent did thereupon subscribe his name at the end
of said Will, as an attesting witness thereto, and at the request and in the
presence of the said testator.  And this deponent further saith, that at the
said time when the said testator subscribed his name to the said last Will
as aforesaid, and at the time of the deponent¹s subscribing his name as an
attesting witness thereto, as aforesaid, the said John A Ware was of sound
mind and memory, of full age to execute a Will, and not under any restraint
to the knowledge, information or belief of this deponent:  And further these
deponents say not.
