No date Appearance bond for Benjamin RICE with Elizabeth BANKS and James BANKS, all of Goose Creek to appear and answer a charge of stealing two pigs the property of Rolin DIXON of Goose Creek. 30 Mar 1840 Prosecution bond by Rolin DIXON to prosecute his case against Benjamin RICE for stealing two pigs from him. 30 Mar 1840 Summons for Roland DIXON to appear and testify on behalf of the State in a matter in which the State is plaintiff and Benjamin RICE is defendant. May 1840 In response to a complaint by Rolen DIXON of Goos Creek that on this day 23 Mar 1840 Benjamin RICE feloniously stole and carried away two pigs from Rolen DIXON, constable is ordered to bring Benjamin RICE before a Justice of the Peace to answer the complaint. 29 Mar 1840 Jury presents that on 1 May 1840 that Benjamin RICE took two pigs from Roland DIXON. May term 1840. [Note dates: The date 1 May 1840 does not make sense, compared with the other documents in this case. It is clearly written this way, however, and the other dates are also clear. In reviewing later documents, it appears that the Grand Jury used the first day of the month when they met as a proxy date, rather than the actual date]. Based on complaint by Enoch ALEXANDER that his store was broken open on Monday night and was robed of one bag of coffee and other articles, and that he thinks that Jim the slave of James G. STANLY, Esq. was concerned in the robbery, order to any law officer to bring Jim before a Justice of the Peace to be dealt with as the law directs. 18 May 1842. Back: "The complainant & defendant appeared before me and was heard. It is ordered that the defendant be discharged forthwith and that the complainant pay the cost." s/Joshua SCOTT, JP. 19 May 1842 William P. BIDDLE for himself and the Wardens of the Poor of Craven County complains that John WHITFORD owes them $100 due by Act of Assembly. WHITFORD allegedly trafficked with a slave of BIDDLE's named Guy for a certain quantity of Indian corn, Guy not having permission in writing from BIDDLE his master to sell the corn. [The fine for this action is $100 paid to the Wardens of the Poor]. Any law officer is ordered to bring WHITFORD before a Justice of the Peace to answer the charge. 15 Jan 1842. DONNELL: Requested to state what he knew in reference to a fight between Same DRAGG and Same CHASE-no relation to either and friendly to both-saw neither that morning before the fight. That Same CHASE told witness that when Saml DRAGG slit one the chest he Saml CHASE told him Saml DRAGG that he ought not do so. Saml DRAGG says damn you I will split you open. Saml. CHASE said to Saml. DRAGG if you come out I will split you open. When he CHASE came out of the door with a piece of wood in his hand, Sam DRAGG came to the door with a carpenters edge and made a swing at him and cut open his finger on his left hand. Sam DRAGG was making a second blow at Saml CHASE when he Saml CHASE stooped down and slipped his hand lower down to steady stick and lodged his cut hand on top of stick and gave a sweep round and struck Saml. DRAGG on the head. Saml. DRAGG fell. Saml. CHASE then came to the kitchen to have his hand bound up. Jim belonging to Mrs. SHEPARD and living with R.S. DONNELL: Stated that he was sent for in order to do up Saml. CHASE's finger. Seeing Sam. DRAGG laying under the workbench asked him if he intended committing murder before he died. Sam DARGG asked him why he said so. When witness replied why did you cut his finger, Sam DRAGG said if he did cut his finger he Saml CHASE knocked him down. Saml. DRAGG stated to witness that he did wish to commit murder. While witness was talking with him Sam DRAGG, DRAGG got up and walked to the shop, and afterwards returned and threw a stick in the bench and then laid down under the bench. Saw no blood on Saml DRAGG. Was not dead when he was carried into the house. He was called but did not answer. Distant relative to Saml DRAGG and Saml CHASE. Threw up several times after he was carried into the house. Smelled of liquor. Threw up no blood. Ben belonging to R.S. DONNELL: Stated that Saml. CHASE told him that Saml. DRAGG struck him with an adze when he (CHASE) struck him over the head with a piece of wood. Found Saml. DRAGG laying side of work bench. Saw little blood on top of his head. Called him and stood him. He did not speak. Carried him into the kitchen. Rubbed him. Continued breathing occasionally throwing up. Died about 12 O'clock. Judged it was between 8 and 9 o'clock when he came to him. Saw blood on the edge of the adze. Jury found the deceased laying in kitchen dead 25 May 1852 at about 10 o'clock AM with blood on top of the head, face swollen. Blood about his nose. Proceeded to have his hair cut off his head and found that he came to his death by a blow or blows inflicted on his head and that the blow or blows were inflicted by Saml. CHASE. This was an indictment against the defendant HARRISS a free negro for keeping in his house and carrying about a shot gun, contrary to the Act of Assembly. It was admitted that the defendant was a free negro, and it was admitted on the part of the State that the defendant had a license from the Court of Pleas and Quarter Sessions of the County of Craven to "keep about his person and carry on his own land, a shot gun." At the time when the offense is alleged to have been committed, it was in evidence that the defendant, in company with certain white persons had gone hunting, and had carried his gun off his own land. Upon these facts agreed, and upon an intimations from his Honor that the County Court could not limit the license, judgement was entered in favor of the defendant, from which judgement the solicitor for the State appealed. Witnesses: John J. BRABBLE, B. M. SPRUILL. No date The following is a Supreme Court of NC opinion in the Craven Co. case State vs. Lawrence DAVIS. [Opinion written by Pearson, Ch I] "The conviction of the defendant may involve the proposition that a free negro is not justified, under any circumstances, in striking a white man. In this we cannot yield our assent. Self defense is a natural right, & although the social relation of this third class of our population, & a regard for its proper subordination, requires that the rights should be be restricted, nothing short of manifest public necessity can furnish a ground for taking it away absolutely because a free negro, however lowly his condition, is in the "peace of the state" & to deprive him of this right would be to put him on the footing of an outlaw-so that while the law will not allow a free negro to return blow for blow & engage in a fight with a white man under ordinary circumstances, as one white man may do with another, or one free negro with another, he is not deprived absolutely of the right of self defense, but a middle course is adopted, by which, in order to make out a justification for a battery on a white man, the free negro is required to allege & prove that it became necessary for him to strike in order to protect himself from great bodily harm or grievous oppression. This conclusion is, we think, deducible from the adjudications of our Courts, of considerations growing out of the abnormal state of society caused by the existence of free negroes in our midst, calling for a new application of the principles of the common law, the excellence of which consist in the fact that it is flexible and expands so as to embrace any new exigence or condition of society-so that while, on the principle of self protection, the paramount rights of the white population are secured, the rights of this inferior race are made to give place as far, but no farther, than is necessary for that purpose. In State vs. James [can't read] 253, it is held, insolence from a free negro to a white man will cause a battery, in analogy to the principle which had been previously settled in respect to the insolence of a slave to a white man. In State v. Cesar & Fred 382, Ch. I. RUFFIN although he dissented in respect to its application to that case, concurred in the opinion, that on a trial for homicide the rules applicable to white men were not applicable to the case of a slave killing a white man- that if a slave receiving a slight blow should kill a white man with a deadly weapon, it would be murder-but if the blow was a severe one, inflicted under circumstances giving reasonable ground to apprehend that bodily harm, or if unusual circumstances of apprehensions occurred, there would be legal provocation-without undertaking to decide that a free negro stands precisely on the same footing with a slave who strikes a white man other than his master or one having authority over him, we think it follows from the principles established by these cases, that although a free negro upon receiving an ordinary blow is not allowed to strike back & get into a fight with a white man, yet if there be cruelty or unusual circumstances of oppression, a blow is excusable because in such a case a resort to the natural right of self protection is not inconsistent with that feeling of submission to white man which his lowly condition imposes, & public policy requires should be expected. If in the case now under consideration the conviction of the defendant involved simply the proposition of law stated above the we differ from his Honor in respect to its application. An officer of the town, having a notice to serve on the defendant, without any authority whatsoever, arrests him & attempts to tie him!! Is not this gross oppression? For what purpose was he to be tied? What degree of cruelty might not the defendant reasonably apprehend after he should be entirely in the power of one who had set upon him in so high handed & lawless a manner? Was he to submit tamely? -and was he not excusable for resorting to the natural right of self defense? Upon the facts stated, we think his Honor ought to have instructed the jury to find the defendant not guilty-There is error- venire de novo." This cause came on to be argued upon the transcript of the record from the Superior Court of Law of Craven County-Upon consideration whereof this Court is of opinion that there is error in the proceedings of the said Superior Court as delivered by the Honorable, the Chief Justice thereof, be certified to the said Superior Court. Spring term 1861 [Incomplete document]: Jurors present that John S. WHITEHEAD and Isaac BROWN, not having the fear of God before their eyes but being seduced by the instigations of the devil, on 1 Mar 1861 made an assault on William FENNER, a free negro. WHITEHEAD held a tiller in his right hand and struck and beat FENNER upon the head and neck divers times giving him mortal wounds and contusions in and upon his neck and head; FENNER then and there instantly died.
