Warrant issued for Abraham BLACKSHEAR to appear and answer John BROWN and Jean his wife of a plea of Trespass on the Case &c, damages £500, witness Lewis BROWN, Clerk of Court. The plaintiffs by their attorney John SITGREAVES filed their Declaration as follows: (P. 2-3): John POLLOCK by his last will and testament made on 21 Sept 1770 bequeathed to the child his wife was then pregnant with the first child his Negroe Clarry should bear after his Decease. The child his wife was pregnant with is Jean now one of the plaintiffs and married to John BROWN. The Negroe woman Clary did after the Decease of her master bring forth a child which was called Phebe which John [POLLOCK] had devised to Jean, that Phebe has been since lost and came by finding to the possession of BLACKSHEAR, that he detains Phebe, to the damage of the BROWNs of £500. A jury of John TAYLOR Alexander HICKS, Solomon SANDERS, Jacob LEE, John WILLIAMSON Jr. James HARRISON, John PYBAS, Benjn. LAVENDER James WILLIAMS, John SHINE, Edwd FRANK & Edward BRYAN who found for the plaintiff and assessed £100 damages. The defendant motioned for an arrest of judgement for this reasons: Even if the declaration of the plaintiff is admitted, it is not enough to support the action, because the property bequeathed [i.e., the slave Phebe] was not in Esse [i.e., Phebe’s mother was not yet pregnant with her] at the time of the bequest, nor till some time after the death of the Testator. The case was continued for argument until September 1787, and the plaintiffs ordered to return the £100. BEZEY thought at that time this was done to please his children, as he did not particularly call on those present to particularly notice it. After this at the making of FOREMANS will, drawn by Henry SNODE, BEZELEY heard him order Patt to his five daughters which were particularly named. SNODE asked what was to pay his debts, and FOREMAN replied and said all the rest of my Estate to pay my Debts & Raise my Children, and that he did not with to give his Children anything but Patt. After FOREMAN’s decease, a judgment was obtained against estate at the suit of Thomas BUSLEY & Thomas JONES, and the sheriff Col. Thomas BONNER levied the same on Patt and exposed her to sale. Thomas JONES, Guardian to the Children did forbid BONNER selling Patt, saying there was other property sufficient to pay the Debts. BONNER replied that he saw no other property & that he should sell her in discharge of his duty & sold Patt to Wm SPEAR, the highest bidder. At the sale which lasted almost an hour, disputes arose about the property of Patt and after the sale, Simon JONES said that if the property had been good or not disputed he would have given 20 or 30 pounds more for her than she was bid at to Mr. SPEAR, in whose hearing the disputes was raised & Debated. (Land was in Dobbs Co. on Cotentnea Cr). Prior to executing the deed, however, CANNON was to give SHEPPARD a bond for 100,000, to become void when the deed was executed. CANNON goes on to say that he was prepared to execute the mortgage deed as soon as SHEPPARD presented it to him, but rather than do that, SHEPPARD sued out an execution on the bond in Edgecomb Co. Court, and CANNON was compelled to sell both the property and other articles in order to make good the bond. CANNON claims that SHEPPARD “craftily” defrauded him by refusing to present the mortgage and void the bond. SHEPPARD by his attorney Thomas LIND denied the charge. The case was continued several times, until January term 1785, when it was heard. SCOTT asked him if JORDAN did not ask him if he did not think the right SCOTT have him would clear of the money SCOTT charged him with, answered he heard JORDAN speak words to that purpose as well as he remembered. Asked what answer did you give him, says he told JORDAN he thought it would not, because the word Senior in the recept will prevent its discharging him. SCOTT asked if JORDAN did not take up a note on acct. Of due bill or a Recept, answer he did. Date: 20 November 1788 Date of: Order County: Pitt Folder: 1788 Information: Deposition of John JORDAN: Has no personal interest in the case between Henry SCOTT and Thomas JORDAN. Saw T. JORDAN sign a receipt sometime the last of September or beginning of August 1785 declaring the recipt of moneys, certificates & publik claims of different kinds, received by T. JORDAN of SCOTT. Remembers to have heard query of doubts at the time of this recept whether the claim of ALDERSON would pass with the Publick Treasurer. Believes that the receipt that T. JORDAN gave SCOTT was for the whole amount of the recepts and claims and that of ALDERSON. Heard SCOTT say that he had the claim of ALDERSON, but not the purpose. Heard SCOTT on Tryal in Hyde court between T. JORDAN and SCOTT that he had given the claim of ALDERSON at some other time. Believes that SCOTT uttered a falsity in saying that. Date: 18 May 1789 Date of: Deposition County: Pitt Folder: 1788 Information: Oath by Thomas JORDAN stating that when a verdict was reached against him in Hyde County Court, that he served notice of appeal immediately, which was granted, provided his attorney filed his reason. His attorney said he would do it that day, but the court adjourned suddenly that afternoon, and the clerk would not accept the appeal, because court had adjourned. The clerk allowed JORDAN to post a bond, which they did. JORDAN has since received notice that execution had issued out against them because his attorney had not pled his reason. JORDAN said that when he proposed his securities and they were approved, they were ready, but the bond was not. Date: 19 April 1788 Date of: Oath County: Not given Folder: 1788 Information: Depositions taken in Hyde County of John JORDAN, James WEBSTER, and Seth HOVEY in the case of Henry SCOTT vs. Thomas JORDAN. John JORDAN’s deposition is complicated, but seems to be saying that SCOTT gave T. JORDAN a quantity of money & public claims to take to the Public Treasurer. T. JORDAN did not get a receipt from the treasurer for the full amount, because there were claims that would not pass. There was no money in the receipt because Richard BLACKLEDGE had given T. JORDAN claims to carry to the treasury, and he passed the claims and gave BLACKLEDGE the money due. SCOTT was worried about discrepancies in the amounts, and the fact that he had not been aware of claims that hadn’t passed--these were apparently from HOVEY and ALDERSON. T. JORDAN offered to give him all of the claims, but SCOTT refused. J. JORDAN was asked when Thomas JORDAN, Sr. died, and he answered sometime in October 1786. J. JORDAN heard SCOTT say he gave the recipt to T. JORDAN junr., and the present T. JORDAN found in his Decd. Fathers papers, J. JORDAN says SCOTT said he gave the recept to the Decd. JORDAN’s acct., and says SCOTT denies he gave the Recpt at all. [Not clear what T. JORDAN Sr. has to do with this--maybe he is the one who received the claims?] WEBSTER states that SCOTT & JORDAN were in dispute on a settlement. SCOTT offered JORDAN twenty shillings to strike him. JORDAN allowed evidence to see that SCOTT did give him that twenty shillings to strike him, SCOTT took the bill out of JORDANS hands & no blows passed as he saw. Afterwards JORDAN told him to take notice that SCOTT was going to give him a receipt which he saw JORDAN write and SCOTT sign. WEBSTER did not remember the date. JORDAN showed him a receipt which said “Recd of Thomas JORDAN Senr [note: in the written deposition, the word “Senr” is inserted after the original sentence] five shillings in full of all debts, dues & demands to 27 Jan 1787.” SCOTT answered he believed it was signed at Mr. HANCOCK’s in Woodstock. SCOTT asked WEBSTER what settlement it was; WEBSTER answered he understood it was on acct. of somc money JORDAN carried to the public treasury for SCOTT. HOVEY states that JORDAN produced a receipt that said, “Recd. of Thomas JORDAN Senr five shillings in full of all debts, Dues & Demands, to the 27th day of Jany 1787. - Henry SCOTT.” HOVEY states he heard SCOTT say he signed that Recpt. SCOTT asked HOVEY if he heard him say whether he signed it for he present JORDAN or for his father, HOVEY answered for his father. T. JORDAN asked HOVEY what time his father, Thomas JORDAN Senr. Died; HOVEY answered sometime in October 1786.
