F. Freize dec'd lately in our Superior Court of Law held for the County of Craven recovered against James Dunn adm'r of William Dunn the sum of five hundred dollars for damages with interest from 1st Janr'y 1833 and also the sum of twenty dollars adjudged and taxed for costs and charges in said suit expended, whereof the said administratior is convicted and liable as appears to us of record: and whereas it was further found by the jury impanelled in the said cause, that the said James Dunn administrator had fully administered, so that execution of said damages and costs cannot be had against the personal estate of William Dunn and whereas the said plaintiffs have suggested to us that the said William Dunn died seized and possessed of a large real estate, sufficient to satisfy said damages and costs, which has descended to Samuel Dunn, Sarah Dunn, William Dunn, Robert Dunn & Charles Dunn heirs at law of said William Dunn and the said plaintiff having solicted some fit rememdy in this behalf, and we willing what is right should be done, command you to make known to the said Samuel Dunn, Sarah Dunn, William Dunn, Robert Dunn & Charles Dunn, to appear before the judge of said court at the court to be held for Craven County at the Court-House in Newbern, on the 4th Monday after the 4th Monday of September next to shew cause if any they have, wherefore the said plaintiffs should not have execution of the aforesaid damages and costs against the aforesaid real estate, descended as aforesaid, and further to do and receive whatsoever our said court shall order and decree in the premises. Herein fail not, and have you then and there this Writ. Witness, James Taylor Clerk of our said court at Newbern the 4th Monday after the 4th Monday of March in the LIX year of our Independence, AD 1835.
