RICHARDSON, Esther ELLISON, Lewsy JACKSON, Hariet ROLINSON, David ROLINSON Witness statements: Witness T. HILL stated that she had come to visit her [i.e. Emley's] mother. Asked Emley if she was in the family way and advised her not to wear her corset too tight. Later Emley told her she had had the baby [handwriting and spelling are hard to decipher--there's something here about someone drinking brandy and having what sounds like a seizure--not sure if that was Emley or Tenor]. Emley said the baby was just as long as her hand. She tried to get her brother to go after Dr. SMITH, but he did not go. "When I had it it was ded you know it was not mutch for I put it in a small chamber." Emley told Tenor she buried it in the garden, but Tenor found it in the horse lot. Tenor said, "I tock the dirt off my self the size of the child did not corespond with her first statement." ELLISON said she came with Tener and saw her take the dirt off the child. The child was bruised on its neck and shoulder. Lewsy JACKSON coo-berates the testimony of ELLISON. H. ROLINSON says she buried the child in the ox lot; the child was borne in the kitchen. D. ROLINSON states Emley asked him to go after the doctor; he went but did not say anything to him; it was about sunrise. When ROLINSON saw the doctor it was too late, and he didn't say anything. RICHARDSON stated that the baby was a premature birth or miscarriage. It was not born within 3 months of its time. Inquest verdict: Inquest held at Swift Creek. This was initially reported as a case of infanticide. Verdict based on information from RICHARDSON; Emley HILL was fully acquitted of any criminal intent as to the cause of infanticide.
