KINSEY says he is father of deceased. Heard Jim halloaing in the woods, and at first paid no attention, since the boys often do that when they're after squirrels. After awhile, they were making so much that he came to him & he said John got too nigh the tree and it fell on him. Went to where John lay and found him dead. They were out there looking for a squirrel the dog had treed and in order to get to the squirrel they cut down the tree & it fell on John about 3:00 PM. J. KINSEY said that his father had sent him out to see what made so many buzzards. Saw that the dog ran a squirrel up a tree. Called John to get a gun to shoot the squirrel down, but John brought an ax and cut the tree almost through. Gave the ax to James, and told him to finish it while he went to the top of where the tree would fall and get the squirrel. When the tree fell he looked for John, but couldn't find him, so went where he saw him last. Found him lying dead with his head smashed in. John was his brother. D. KINSEY said she did not know anything about it; she was not home. She was on her way to New Bern when she heard it and came back. F. KINSEY said he knew nothing about it. D. DAY said he knew nothing except that he heard the dogs halloaing like they were after squirrel. Later he heard a different noise--crying and moaning. He went there and found old man John's and Jim's father, and he said that John was dead and the tree fell on him. W. SHADE said he heard the dogs barking, then a smashing sound. Soon heard a voice calling for help and after awhile Jim come out to where SHADE was and said come to father a tree has fell on brother John & killed him. Inquest verdict: Inquest held 21 Jan 1880 near deep gully on the Trent Road. Came to his death by the falling of a tree on him accidentally that was cut down by his brother and we believe it was purely accidental.
