All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jo Huettl johit@suddenlink.net November 15, 2009, 9:36 pm Source: State Archives, Raleigh Box Cr-028-508.9 Written: 1801 On sleeve: Petition of Elizabeth Partridge Thoms Partridge, Lucas Benner & Wm Jones & Wife for devision of lands – Commipioners appointed March Term 1801) John Benners Estate Record State of North Carolina Craven County Court of Pleas & Quarter Pepions March Term 1801 To the Worshipful the Justices of the County Court of Please and Quarter pinions for the county aforesaid now siting The petition of Elizabeth Howard, William Jones & Elizabeth Jones his wife of Tomas Partridge by his next friend Benners Vail, and Lucas Benners by his next friend Lucas Jacob Benners humbly sheweth to your worships that John Benners late of Craven county departed this life on or about the 10th day of December last part having first duly made his last will & testament in writing and therein among other things loaned to your petitioner Elizabeth Howard for and during her natural life one third of twenty two hundred & thirty acres of land on South River called the Golden Grove, which should include the part next to South River & one third part of the cleared lands; and after her death he devises the same to your petitioner Lucas Benners in fee simple and to your petitioner Thomas Partridge he devises in fee simple another third o the said twenty two hundred & thirty acres of land & should be laid off next to the part loaned to your petitioner Elizabeth Howard to include one third part of the cleared land. To your petitioner Elizabeth Jones he devises the other third or remainder of the said twenty two hundred & thirty acres of land, as by a reference to the said last will & testament may more fully and at large appear. Your petitioner further shew unto your worships that they are desirous of having all the said tract of land above mentioned divided laid off to them agreeably to the will of the said John Benners. Your petitioners therefore, pray that worships will be pleased to grant them an order & appoint commipioners to dived lay off & appropriate the said lands agreeably to the directions of said will and make return of their proceedings to next court agreeably to the directions of the law in such cases made and provided & your petitioners as in duty bound shall we pray.
