He came to New Bern and found one of the boats and got an officer to search the house of PADOCK & SMITH, where was found some pork a piece of which was part of the same pork that was stolen. Examination of John HILL: Says he came down in the boat in which the pork was, that the pork was carried up to PADOCK & SMITH store, amongst which was the piece sworn to by William WHITE. Examination of Nathan MARCHLAND: Says he came part way to New Bern that some pork landed from the boat which was carried up in bags to the store of PADDOCK & SMITH. Examination of Stephen WHITE: Says he asked PADDOCK & SMITH if they bought that pork (alluding to some pork their in their store) down the river with them. One of them answered in the afirmative.. Nearly 2 months prior to the court, he received information that a considerable property in Maryland had descended to him by the death of an uncle and that he would sustain great loss by delaying to take possession, "the property being Prey to the rapacity of strangers," so he went to Maryland. While there he became violently sick, and was unable to travel for 10 days. This was why he failed to attend court. (On back: PONSONBY says that he has been told that the Grand Jury found the charge of larceny to be Not a True Bill, and he is not sure about the other charge, but believes that the person said to be wronged has been fully compensated).
