It continued, then "Joshua gave Simon the lye which was immediately returned by Simon" and soon Joshua crossed to Simon and struck him, Simon returned the blow, and Elizabeth ran between them and tried to appease them, but without success. Joshua struck around her and hit Simon, first kicking at Simon and missing. Blows were given on both sides with naked fists and no other weapon. Soon after the blows passed, Joshua sat down, and Simon said you are going to faint. Joshua at first denied this, Simon insisted, and Joshua acknowledged it. Joshua, near expiring, "observed to his brother Simon that it was his own fault that what had happened did and said altho he was like to die he forgave him, or words to that effect and soon after expired." Benjamin PARROTT made oath that yesterday about 1 or 2 oıclock in the afternoon he received a message from his mother that his 2 brothers Joshua & Simon were fighting & to come, which he immediately did, "& when he got there he found his Brother Joshua lying in an apparant condition of death in the Rye field when this deponent asked him what was the matter & how the accident happened which repeated perhaps in other words and recd no answer, he then asked him where his misery lay he answered in his left side and died perhaps half an hour afterwards. He heard a knocking at the back door, in he opened a window so that he might find the keys which had been mislaid. He heard disputing between 2 men, believed to be Wm. MASON and Andrew MOODIE. The first words he heard were MOODIE saying, "I wonıt fight you damn you stand off or I'll stab you." POWERS then went to the front door & heard MASON call out "I am bleeding to death." On opening the door MASON fell on the steps and POWERS saw some person that he believes to be MOODIE running away. After being in the house and fixed in a chair, MASON reported 3 or 4 times that MOODIE had stabbed him. Shortly after her first acquaintance with him, she was informed that he was stabıd and at the house of John POWERS. She went immediately to POWERS, it being in the night about 10 or 11 oıclock, and found MASON bleeding. He had his hand laid over the wound, which was in his right breast. She asked him who had done it, and he said MOODIE. ROACH stayed with him all night and the next morning took him to her house, where he remained until last Wednesday, when he died. OSBORN: OSBORN states he was called to visit William MASON on Saturday night about midnight. He found MASON in bed but unable to lie down and complaining of great pain in his breast. MASON had received a wound between the 2nd & 3rd ribs, which was then bleeding with considerable violence. A divided artery was discovered from which the blood which flowed externally proceeded. OSBORN tied the artery, causing the bleeding to wane, but when MASON changed his position, the occasional discharge of air from the orifice led OSBORN to suspect that the lungs had been punctured. He developed violent inflammation of the chest a few days later, and Dr. PASTEUR his attending physician prescribed various remedies. On the 18th day from his being wounded, OSBORN was informed that he had expired on that morning. He was requested to attend his dissection. On opening the body the right lobe of the lung with its covering was entirely destroyed apparently from a mortification. The pericardium and heart had appearances which indicated that the inflammation had extended also to those parts. The wound appeared to have passed by the ribs & was on the inner parts of nearly the same lengths as externally. The putrid & dissolved state of the pleura & lungs rendered it impossible to ascertain the depth of the wound, but there appears from all circumstances a strong probability that the instrument had penetrated his lungs & thereby occasioned the inflammation, mortification & death.
