term, 1798 against Francis WEBBER for an assault on Henry BETTNER. 2) WEBBER 
then appeared in county court, represented by his attorney Benjamin WOODS, and 
pleads Not Guilty. A jury consisting of Edward KEAN, Nathan TISDALE, John 
GREEN, William TRIPPER, Richard FONVILLE, Roger JONES, Abner PASTEUR, John 
ALLWAY, John DEVEREUX, James Reed EMORY, William ATTMORE, & William JOHNSON 
was called, but one of the jurors failed to answer, so the case was continued 
Œtill next term. 3) At the next term, the following jury was called: Roger 
JONES, Thomas HYMAN, William GARDNER, Willis MOURNING, Isaac WINGATE, Peter 
PHYSIOC, David GATLING, Charles HATCH, Alexander CARRUTHERS, Richard 
BARRINGTON, James REEL Junr., & Thos. HALL This jury found WEBBER not guilty, 
Benja. H. MARTIN, atty for the state appealed. This was granted, and WEBBER

Information: Oath of Francis WEBBER that he had posted bond to appear in 
Superior Court at the March term, 1799 to answer a charge of assault on Henry 
BITNER, for which he had already been acquitted, but that urgent and necessary 
business caused him to sail to the West Indies before he could appear. To have 
delayed the voyage would have caused him great risk and inconvenience in his 
affairs. He was informed by his attorney that he could authorize his attorney 
to appear on his behalf in minor case such as this, and that his personal 
appearance was not necessary, if the attorney general agreed. He therefore set 
sail, and his attorney (Benjamin WOODS) appeared on his behalf. The attorney 
general, however, did not agree to his absence, and he and his bondsmen were 
called out on their bond. WEBBER then says that he attempted to appear in 
court as ordered (September term, 1799) to appeal the forfeiture of bond, but 
was prevented from this by the sickness of his counsel who was confined to 
bed, and the premature adjournment of court on account of the prevailing 
fever.

Information: Oath by Benjamin BRACKET, sheriff, that he used every reasonable 
exertion to arrest Phillip CRUTCHFIELD. BRACKET went to CRUTCHFIELDıs 
residence, but was not able to find him; he was told that CRUTCHFIELD stayed 
out at night for the purpose of avoiding arrest. BRACKET came across 
CRUTCHFIELD on 2 occasions by accident and attempted to arrest him, but on the 
first occasion CRUTCHFIELD threatened him with a loaded gun, and on the second 
with an axe. There was no one that BRACKET could call on for assistance, and 
he was not aware that he had a right to call on the powers of the county for 
assistance, but even if he had, he doesnıt think heıd have found him.

the document is creased, torn, and stained.-sbg]. Examination of Lydia ? 
Wigmores, aged about 17 years, regarding the death of Richard JASPER. She 
states that she heard [creased-- appears to indicate wife of Green PARKER-sbg] 
between sunset and the dark of the evening, swearing and cursing at Mr. 
JASPER. Lydia went into the garden of Green PARKER where Mrs. PARKER was and 
heard Mrs. PARKER threaten to kill him with her [canıt read] which she held in 
her hand. Shortly after, she saw Green PARKER in the garden with something in 
his hand which she took to be a sword. PARKER stabbed JASPER. JASPER 
immediately set off for his own house and requested his wife to send for a 
doctor and walked to the porch at his door where he ? his breast and 
immediately expired. 

When asked if she heard JASPER strike or threaten to strike Mr. or Mrs. 
PARKER, or if he had a weapon, she said no.

Mr. PARKER askıd if she did not see JASPER have horsewhip, and if she did not 
see [torn]. She said she did not. [Note: witness signed with X]
