To have delayed the voyage would have caused him great risk and inconvenience in his affairs. He was informed by his attorney that he could authorize his attorney to appear on his behalf in minor case such as this, and that his personal appearance was not necessary, if the attorney general agreed. He therefore set sail, and his attorney (Benjamin WOODS) appeared on his behalf. The attorney general, however, did not agree to his absence, and he and his bondsmen were called out on their bond. WEBBER then says that he attempted to appear in court as ordered (September term, 1799) to appeal the forfeiture of bond, but was prevented from this by the sickness of his counsel who was confined to bed, and the premature adjournment of court on account of the prevailing fever.
