Testimony by S. AVERITT that RIGHT lived in her house, and that on 15 November 1828 he got up in the morning and took his gun and said he was going to "kil sum ducks in the Creek." AVERITT later heard a gun shot. When RIGHT had not returned by the next day, she became uneasy and gave the allarm. Testimony of BUTLER, A. ATKINSON and J. ATKINSON: Went to S. AVERITT's house on Sunday morning the 16th of November, and Mrs. AVERITT informed them that RIGHT had left her house the previous morning and not returned, and she wanted them to go look for him. They went to the creek and found the gun standing by a tree, and concluded that he had drowned. They fired several guns across the water and at length RIGHT "Ris" and they found him and made him fast until a jury could come. Verdict that RIGHT, being alone in Swift Cr accidentally drowned.
