White & others, 1859 ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ Court of Equity, Craven, Fall Term 1859, pg. 274 App. No. 11 In the matter of Whichcote White, Leroy M. White, Thomas Becton & wife Nancy, M. W. H. Sumrell & wife Emmeline, Teresa Burnett, William H. Ward & wife Nancy, Zachariah Pate & wife Harriet, Mary F. Jones, Furney G. Jones, Charles S. Jones, Leroy M. White & wife Nancy, & the heirs at law of Mordecai White decd. This house coming in to be heard upon the petition, affidants filed report of the Master & being heard the court doth declare that the petitioners Whichcote White & others are tenant in common of the tracts of land specified in the petition & are entitled in the following proportions: To wit: Whichcote White, one sixth - Leroy M. White as devisee of Lewis White decd. One sixth - Leroy M. White & wife Nancy, one sixth - Thomas Becton & wife Nancy, M.W.H. Sumrell & wife Emmeline, & Teresa Burnett, one sixth - William H. Ward & wife Nancy, Zachariah Pate & wife Harriet, Mary F. Jones, Furney G. Jones & Charles S. Jones, one sixth - & heirs at law of Mordecai White, one sixth - The Court doth further declare that actual partition of said lands cannot be made without serious injury to the parties witnessed - It is therfore ordered, adjudged & decreed that the Clerk & Master, After due advertisment in some gazette printed in the town of Newbern proceed to sell said land at public sale to the highest bidder on a credit of 6 months taking bonds with approved security for the payment of the purchase money. - Court of Equity, Craven, Fall Term 1859, pg. 324 No. 43 On the matter of Whichcote White, Leroy M. White & others Decree confirming the sale- The Clerk & Master having filed his report showing that on the 13th day of December last he sold the lands specified in the petition, when Jesse M. Coy became the purchaser, he being the highest bidder, at the price of one thousand & thirty five, and having also filed the bond of the said purchaser, dated on the day aforesaid: And the Court decreeing the said sale fair and at a just price, it is therefore ordered, adjudged, and decreed that said sale be confirmed in all respects, and the Court doth allow the Master the sum of twenty dollars for his said sale & report - and the Court retains the cause for further directions - Transcribed by Marian Ryall, December 31, 2004.
