All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jo Huettl johit@suddenlink.net November 3, 2009, 6:32 pm Written: 1771 (Copied from State Archives, Raleigh) This indenture made the twenty eight day of February in the eleventh year of the reign of our sovereign Lord George the Third and in the year of our Lord One thousand seven hundred and seventy one between Henry Darnell of the Town of New Bern in Craven County and Province of North Carolina of the one part and William Yarborough of New Bern in the County and Province aforesaid Mariner of the other part. Witnesseth that for and in consideration of the sum of fifteen pounds proclamation money by the said William Yarborough to the said Henry Darnell in hand paid the receipt where of is hereby fully acknowledged, He the said Henry Darnell hath given granted bargained and sold and by these presents doth give grant bargain and sell unto the said William Yarborough his heirs and assigns a certain piece or parcel of land in the Town of New Bern in the County of Craven and Province of North Carolina situate lying and being on the West side of Edem Street containing one quarter of an acre of land be the same more or less being the Southernmost half part of the lot known in the plan of the said Town by the number two hundred and five (205). Containing in breadth in Edm Street Three poles and a quarter and running westerly thirteen poles which said lot was granted by the commissioners of the said Town to Robert Carruthers and by Eunice Carruthers & Lydia NeDelear conveyed to the said Henry Darnel as by the said deeds registered in the registers office of Craven County reference being thereunto had may more fully appear. To have and to hold the aforesaid, part of a lot or quarter of one acre of land with the appurtenances and all rights and privileges and improvements to the same in any wise belonging to live the said William Yarborough his heirs and assigns for ever. And the said Henry Darnell for himself his heirs and assigns doth hereby covenant and agree to and with the said Yarborough that he the said William Yarborough his heirs and assigns shall and may forever hereafter peaceably and quietly have hold occupy posses and enjoy the afore granted land and premises inthout the lot or moles listed f any person whatsoever and free and clear from all and all manner of securities & whatsoever rid the said Henry Darnell doth oblige himself his heirs executors and administrators to warrant and defend the afore granted lands and premises to live the said William Yarborough his heirs and assigns for ever against the claim of all persons whatsoever.
