DAWSON, Sheriff of Craven County, State of North Carolina of the one part and Jeremiah N. ALLEN of Newbern, State aforesaid of the other part, Witnesseth whereas there issued forth of the the Court of Pleas and Quarter Sessions of the County of Craven aforesaid a writ of fieri facias bearing —— the second Monday of February in the year of our Lord 1841, directed to the Sheriff of Craven County commanding him of the goods and chattels, lands and tenements of Rigdon MOORE and Harriet his wife, Reuben CLARK and Elizabeth his wife, Rigdon WATSON and Mary his wife, William CLARK and Ann his wife, Boaz TILLMAN, Nancy Ann TILLMAN, Council HOOTEN and Louisa HOOTEN heirs at law of Caleb HOOTEN deceased to cause to be made the sum of Twelve dollars and twenty cents which lately in said Court was adjudged and taxed in the suit in which Maria HOOTEN, widow of Caleb HOOTEN was plantiff and said heirs were defendants for the defendants part of the cost and charges expended int eh suit for assigning the said widow her dower to which said writ of fiere facias was returned to the May Term, A.D. 1841 of the Court aforesaid endorsed, Levied on one half acre of land and improvements lying on Queen Street and Neuse Road adjoining the Town of Newbern and whereas afterwards there issued forth of said Court of Writ of Venditioni Expona directed? the second Monday of may A.D. 1841 directed to the Sheriff of Craven County, commanding him to expire to sale the said half acre of land and improvements levied upon as aforesaid to satisfy the said judgement for costs to and that he should have the said monies before the said Court on the second Monday of August 1841, & all which will mercifully and at large appear by the said Writ afterwards and before the return thereof delivered to the said John B. DAWSON, he being their Sheriff of said County of Craven, and whereas in pursuance of said Writ of fieri facias are the levy thereunder and the said Writ of Venditioni Exponas, the said John G. DAWSON did on the ninth day of August A.D. 1841 after regular advertisement of forty days proceed to sell at the Court House in Newbern the piece of land so levied on and ordered to be sold to the higher bidder when the said piece of land which is more particularly bounded and described as follows viz: beginning at a lightwood post formerly BRYAN’S now FORBES corner on the North side of Queen Street and at its junction with the Neuse Road running thence with the Neuse Road due West six poles and five feet six inches then North one quarter of a degree West twelve poles and eleven feet then East six poles five feet and six inches to FORBES line then along FORBES line to the beginning containing half an acre with the improvements and appurtenances being the same which was conveyed to Caleb HOOTEN by James C. COLE, by deed dated the 21st of September A.D. 1836 subject however to the widows claim to dower in the same, was bid off by Reuben CLARK at a price of Eighty five dollars he being the highest and best bidder, and whereas the said Reuben CLARK hat transferred this said bid to Irvin JACKSON and the said Irvin JACKSON hat transferred the same tot he said Jeremiah N. ALLEN to hold upon the trusts herein after mentioned the said persons paying the sum as which the same was bid off is Now therefore in consideration of the matters therein before recited and of the said sum of Eighty five dollars by the said Jeremiah N. ALLEN to the said John D. DAWSON, Sheriff as aforesaid in hand paid before the execution of these presents the receipt whereof is hereby acknowledged the said John B. DAWSON, Sheriff as aforesaid hat granted bargained and sold and by these presents doth grant bargain and sell unto the said Jeremiah N. ALLEN his heirs and assigns the said half acre of land with its improvements and appurtenances as herein before bounded and described being the same which was levied upon and sold as aforesaid (excepting always the dower of Maria HOOTEN widow of Caleb HOOTEN in said piece of land) To have and to hold said tract of land with its improvements and appurtenances excepting the right of dower aforesaid unto the said Jeremiah N. ALLEN his heirs and assigns forever. In Trust to permit the said Irvin JACKSON to use occupy and enjoy the same and to have and receive the rents issues? and profits thereof during the natural life of the said Irvin JACKSON, and upon the decrease of the said Irvin JACKSON in further trust to surrender and deliver up said piece and parcel of land unto Daniel JACKSON of Newbern to be held by said Daniel JACKSON in fee simple and absolutely, In testimony whereof the said John B. DAWSON, Sheriff as aforesaid hath hereunto set his hand and seal this day and year first above written. Jno. B. DAWSON, Sheriff (seal) Signed, sealed and delivered in presence of Jno. A.
