Sheriff Thomas H Daves to John R Donnell 

This indenture made the fifth day of June A.D. 1819 by and between Thomas H 
Daves Sheriff of the County of Craven State of North Carolina of the one part 
and John R Donnell of Newbern State aforesaid of the other part.  Witnefseth 
that whereas heretofore there ifsued forth of the Court of Pleas and Quarter 
Sefsions of the County of Craven a writ of fierce facids bearing teste the 
second Monday of September One Thousand eight hundred and Sixteen directed to 
the Sheriff of Craven County commanding him that of the good and chattel lands 
and tenements of Gerdin Castix he should cause to be made the sum of one 
hundred and thirty five dollars which Nancy Guillet administratrix of Michael 
Guillet lately in the said Court recovered against the said Germain Castix for 
debt and also the sum of ten dollars and twelve cents for damages besides the 
sum of six pounds thirteen shillings and three pence for the cost and charges 
in said suit expended where of the said Germain Castix was convicted as 
appears of record and that he should have the said monies before the said 
Court at Newbern on the second Monday of December then next following there 
and there to tender the said debt damages and costs aforesaid which said writ 
of five facins was afterwards and before the day of the return thereof 
delivered to Thomas H Daves he being then Sheriff of Craven County. And 
whereas at the time of delivering the said writ to the said Sheriff and at the 
teste thereof and also at the time of recovering the Judgment therein 
mentioned the said Germain Castix was seized in fee of a certain piece or lot 
of land situate lying and being in the Eastern part of Dryborough near the 
Town of Newbern being the whole of the lot which is known and distinguishing 
in the plan of said Dryborough by the number seventy eight excepting such 
parts thereof as have been conveyed by the said Germain Castlix to Obediah 
Norman Thomas Harris and James Y Green by deeds by him duly executed previous 
to the first of December one thousand eight hundred and Sixteen and whereas 
the said Thomas H Daves being Sheriff of the County of Craven aforesaid by 
virtue of and in obedience to to said writ of fieri facices and by authority 
of his said office afterwards and before the day of the return of said writ 
did seize and levy upon the said lot of land in Dryborough excepting do much 
thereof as had been sold as aforesaid and having duly advertised the same for 
forty days sold the same at public venue on the twentieth day of December one 
thousand eight hundred and sixteen to the said John R Donnell for the sum of 
three hundred and sixty dollars he being the highest and best bidder. Now know 
all men by these presents that the said Thomas H Daves Sheriff of Craven 
County aforesaid for and in consideration of the said sum of three hundred and 
sixty dollars to him in hand paid by the said John R Donnell by virtue of and 
in obedience to the aforesaid writ of fieic facides and by authority of his 
said office hath bargained and sold alined enfe offered and confirmed and by 
these presents doth bargain sell alien enfeoff and confirm unto the said John 
R Donnell his heirs and afsignes the said lot of ground in Dryborough herein 
before mentioned and described with all and singular the improvements and 
appurtenances and all the right title interest and estate therein whereof the 
aforesaid Germain Castix was seized at the time aforesaid. 


To have and to hold the said premises to the said John R Donnell his heirs and 
afsigns forever In Witnefs whereof the said Thomas H Daves Sheriff as 
aforesaid hath hereunto set his hand & seal the day & year first above written.
