All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/nc/ncfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jo Huettl johit@suddenlink.net December 6, 2009, 7:00 pm Written: 1819 24 July 1817 (Source: New Bern Register of Deeds, Book 40, Pages 341 & 342) John S Nelson & John R Donnell This indenture made the twenty fourth day of July in the year of our Lord One thousand eight hundred and seventeen between John S Nelson of the county of Craven executor of the last will and testament of Judith Tinker late of the County of Craven decd and John R Donnell of the Town of Newbern Witnefseth that whereas the said Judith Tinker at the time of her death was sized and proposed of a good and endefearsible estate in fee simple in an to a certain piece or part of lot N 19 number nineteen in the plan of said Town lying on the North side of Trent – Front Street adjoining the tenement of William Shephard and extending thirty two feet in front on said Street and running back two hundred & fourteen feet the whole extent of lot N 19 nineteen; and was sized and prophed by her last will and testament – duly executed did divide as follows: viz. my will and desire is that my house and lot in Newbern be sold and the monies arriving therefrom and to pay all my just debts and the over ries if any is to be equally divided between my two daughters Elizabeth Singleton & Juditha Tinker and by her said will appointed the said John S Nelson her executor and whereas the said John S Nelson hath duly qualified as the executors of the said will of the said Judith Tinker and to taken upon himself the execution thereof and for the purpose of enabling him to pay off and discharge the debts of the said Judith Tinker and to give full effect to the said will hath as the executor of the said Judith Tinker bargained and soled to the said John R Donnell all that house and lot of the said Judith in the town of Newbern by her purchased at a sale made under a decree of the Court of Equity for the County of Craven for the purpose of partition among the devices for her decd husband Stephen Tinker and being the part of sd lot first above described in these premises. Now then this indenture witnefs that the said John S Nelson executor of the said Judith Tinker as aforesd for an inconsideration of the premises and of the sum of one thousand one hundred a& twenty dollars to him in hand paid by the said John R Donnell at and before the ensealing & delivery of there hereunto the necefsy whereof is hereby acknowledged hath grant bargain sell alien apsign convey and confirm unto the said John R Donnell all that price or part a lot of land together with all the privileges appurtances and improvements thereunto belonging situate on the North side of Trent Front Street in the Town of Newbern formerly sd property of Stephen Tinker and for the purpose of partition among his devises sold under a decree of the Court of Equity for the County of Craven and purchased by Judith Tinker as aforesaid it being part of Lot N 19 in she plan of town extending on front street thirty two feet or more adjoining the part of said lot owned by William Shepard and running back two hundred fourteen feet or this whole extension of said lot N 19. To have and to hold the said price or part of a lot of land with all its privileges appurtenances and improvements unto the said John R Donnell his heirs & afigns forever unto his and their in only proper use benefit and behalf of forever. And the said John S Nelson the above bargained premises unto the said John R Donnell his heirs & afignes against the lawful claim of all purposes claiming by strength or under him will warrant and forever defend by virtue of these presents. In Witnefs whereof the said John S Nelson hath hereunto set his name and affixed his seal on the day first above written.
