Witnefseth that whereas the said John Green Taylor in consideration of the sum of four hundred and fifty dollars to him in hand paid by the said John R Donnell hat granted bargained and sold aliened enfeoffed conveyed and confirmed and by these presents doth grant bargain and sell alien enfeoff convey and confirm unto him the said John R Donnell a certain piece of land in the Town of Newbern being a part of lot number three hundred and twenty five in the plan of said Town on the South side of Johnston Street beginning at the corner of the lot sold by St. John’s Lodge to Gabiel M Rains being forty feet six inches from the northeast corner of said lot N 325 running west on Johnston Street forty feet six inches thence two hundred and fourteen feet six inches South, then East forty feet six inches to Gabriel M Rains’ line then north with said line to the beginning. To have and to hold unto him the said John R Donnell his heirs and afsigns forever to his and their only proper use and benefit forever. And the said John Green for himself and his heirs doth covenant to and with the said John R Donnell his heirs and afsigns the above bargained premises to warrant and forever defend unto him the said John R Donnell his heirs and afsigns. Provided always and it is hereby exprefsly declared and agreed that if the said John Green his heirs executors administrators or afsigns or any of them do and shall well and truly pay or cause to be paid unto the said John R Donnell his executors administrators or afsignes the sum of two hundred and thirty one dollars and seventy five cents on the twentieth day of July next and the farther sum of two hundred and thirty eight dollars and fifty cents on the twentieth day of January next as by the two promifsory notes of the said John Green payable to the said John R Donnell and bearing even state with these presents is further evidenced. Then and from thence forth these presents and every matter and thing therein contained shall cease and be utterly null and void any thing therein to the contrary thereof in any wise notwithstanding and the said John Green for himself his heirs executors and administrators doth covenant promise and agree to and with the said John R Donnell his heirs executors and administrators that the said John R Donnell his heirs and afsignes shall and may from time tot time and at all times after default if any shall happen to be made in payment of the two promifsory notes as aforesaid or any part thereof have hold occupy profsefs and convoy all and singular the above bargained premises wit the appurtenances without the let suit trouble hindrance or disturbance of the said John Green his heirs or afsignes or any other person claiming lawfully by from or under him them or any of them. And lastly it is covenanted and agreed upon by and between the parties to these presents that until default shall be made in the payment in the said two promissory notes or some part thereof as aforesaid at the time above limits for the payment thereof it shall and may be lawfull for the said John Green his heirs and afsigns peaceably and quietly have hold occupy pofsefs and enjoy all and singular the said premises above granted and every part thereof with the appurtenances anything therein contained to the contrary notwithstanding. In Witnefs whereof the said parties have hereunto set their names and affixed their seals on the day and year first above written.
