Mason http://www.genrecords.net/emailregistry/vols/00023.html#0005630 March 20, 2019, 7:25 pm Written: 1834 Register of Deeds Craven County, NC Bk. 50, p.138 Caleb & Maria HOOTEN of Craven Co., NC to Sarah CARTER of Craven Co., NC 15 Jan 1834 This Indenture made & executed this fifteenth of January A.D. 1834 by and between Caleb HOOTEN & Maria his wife of Newbern, State of North Carolina of the one part and Sarah CARTER of the Town & State aforesaid of the other part & Witness that the said Caleb HOOTEN & Maria his wife for and in consideration of three hundred & ten dollars to them in hand paid by the said Sarah CARTER at & before the delivery of these presents the receipt whereof is hereby acknowledged & from the same and every claim therefor the said Sarah CARTER is hereby released & discharged have given, granted, bargained, and sold and do by these presents give, grant, bargain and sell unto he said Sarah CARTER her heirs & assigns a certain lot of land situated in Newbern aforesaid lying on the south side of Pollock Street in the angle formed by Jones Street on the East by German Street & on the South by the Northern line of lot number three hundred & fifty eight being being the whole of the lot known in the plan of Newbern by the number Three hundred & fifty nine, with all & singular the improvements & appurtenances & which said lot was devised to the said Maria HOOTEN by her father George LANE. To have and to hold said lot of land N 35 q? with all & singular the improvements and appurtenances unto the said Sarah CARTER her heirs and assigns forever. Had the said Caleb HOOTEN & Maria his wife for themselves & their heirs to & with the said Sarah CARTER her heirs & assigns do hereby covenant that they are well seized of a good & indefeasible estate in fee simple in said premises hereby conveyed & have good right and lawful authority to give grant bargain and sells he same as aforesaid that said premises are free & clear of all encumbrances whatever & that they the said Caleb HOOTEN and Maria his wife and their heirs shall & will forever warrant, secure and defend said premises & the appurtenance unto the said Sarah CARTER her heirs & assigns against the lawful claims of all persons whatever. In testimony whereof the said Caleb HOOTEN & Maria his wife have hereunto set their hands and seals the day & year first above written. DONNELL, Judge, personally appeared Caleb HOOTEN and Mariah HOOTEN his wife the parties to the foregoing deed and duly acknowledged the execution thereof, she the said Mariah having been first examined by me privately & apart from her husband touching the execution thereof, and it appearing that she had executed the same freely and of her own accord without the fear or compulsion of her husband, & that she doth voluntarily assent thereto.
