B. HUMPHREY and Ida E. HUMPHREY of the County of Craven and State of North Carolina of the first part and Lydia HOOTEN of the County of Craven and State of North Carolina of the second part: Witnesseth, that the said party of the first part for and in consideration of the sum of One hundred and eighty eight & no/100 dollars in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged hath bargained and sold, conveyed and confirmed and by these presents does bargain and sell, convey and confirm unto the said party of the second part her heirs and assigns forever all the following described piece or parcel of land lying and being in the County of Craven near the town of Dover and known and designated as follows viz: Beginning at a red oak and runs S 32 E 77 poles to a ditch then S 18 West 20 poles to the A & NC Railroad then with the Rail Road N 71 W 96 poles to the STRINGER land then with STRINGER line N 40 W 20 poles to Asa HAWKINS line then with Asa HAWKINS line N 60 E 58 poles to his corner then N 64 E to the beginning containing 27 acres more or less. To have and to hold the same together with all the hereditaments and appurtenances thereunto in anywise appertaining to the said Lydia HOOTEN her heirs and assigns forever. And the said L.B.HUMPHREY and wife Ida E. HUMPHREY party of the first part do covenant with the said party of the second part her heirs and assigns as follows: First, that L. B. HUMPHREY & wife the owners and lawfully seized of said premises; Second that they have good right to convey the same; Third, that the same is free from all encumbrances whatever, and fourth, that the party of the second part her heirs and assigns shall quietly enjoy and possess the same and that they will warrant and defend the title to the same against all lawful claims; Provided nevertheless, that if the said L. B. HUMPHREY and wife of the first part their heirs executors and administrators shall well and truly pay or cause to be paid to the said Lydia HOOTEN party of the second part her heirs, executors, administrators or assigns the sum of One hundred & Eighty eight dollars according to the contain of a certain Bond of even date herewith payable Jan 1st, 1902 with interest at 6% from date, Then their deed to be null and void; otherwise to be in full force and effect. But if defaults shall be made in the payment of either of the said sum of money or the interest or any part thereof at the time therein before specified for the payment thereof the said party of the first part in such case doth hereby authorize and fully empower the said party of the second part her heirs executors administrators and assigns to sell the said hereby granted premises at public outcry at the Court House door in Newbern, Craven County after first advertising the same for 30 days and convey the same to the purchaser in fee simple and out of moneys arising from such sale to retain the principal and interest which shall then be due on the said Bond together with all costs and charges and pay the surplus if any to the said party of the first part his heirs executors administrators or assigns. HUMPHREY (Seal) Signed, sealed and delivered int he presence of W. C. WILSON North Carolina County I, L. G. FERRELL do hereby certify that L. B .HUMPHREY and Ida E. HUMPHREY his wife personally appeared before me this day and acknowledged the due execution of the annexed deed of Mortgage and the said Ida E. HUMPHREY being by one privately examined separate and apart from her said husband touching her voluntary execution of the same; doth state that she signed the same freely and voluntarily without fear or compulsion of her said husband or of any other person and that she doth still voluntarily assent thereto.
