All rights reserved. http://www.usgwarchives.net/copyright.htm This file was contributed for use in the USGenWeb Archives by Jo Huettl - johit@suddenlink.net (Source: New Bern Register of Deeds, Book 2 Page 191) George Miller, Robert Perry, Thomas Bracher & John Perry land sell to Arthur Lipsey North Carolina This indenture made the 12th day of June in the year of our Lord 1758 between George Miller Robert Perry Thomas Bracher & John Perry of Craven County in the Province of North Carolina planters of the one part and Arthur Lipsey of the County & province af sd planter of the other part witnesseth that the sd George Miller Robert Perry Thomas Bracher and John Perry for and in consideration of the sum of £ 20 proc money to them in hand paid by the sd Arthur Lipsey before the ensailing & delivery hereof the receipt whereof they do herby acknowledge & every part & parcel thereof do fully acquit & discharge the sd Arthur Lipsey have bargained & sold & by these presents do fully & fully bargain & sell aline convey & confirm unto the sd Arthur Lipsey his heirs & apsigns forever a certain piece or parcel of land lying & being in the County & province afd on the South side of Trent River lying to John Simmons on the upper side beginning at a pine running thence S 70 N 12 pole to a red oak thence S 20; 126 pole to a pine thence N 70 126 pole to a pine thence N 20 126 pole to the first station containing 100 acres it being a tract of land patented by John Parker bearing date the 10th day of Sept 1737 reference being thereunto & will, more plainly appear. To have & to hold the granted & bargain premises with all the appurtenances, privileges & commodities to the same belonging or in any wise appertaining to him the said Arthur Lipsey his heirs & apsigns forever & then the said George Miller Robert Perry, Thomas Bracher & John Perry for themselves there heirs exts, admst do covenant promise & grant to & with the said Arthur Lipsey his heirs & apsigns that before the ensealing hereof they are the true sole & lawfull owner of the above bargained premises & are lawfully seized & proposed of the same in there own proper rights as a good perfect & absolute estate of inheritance in fee simple & have in them selves good right & full power & lawful authority to grant bargain sell convey & confirm in manner as above. That the Arthur Lipsey his heirs & apsigns shall & may from time to time & at all times hereafter by force & virtue of these presents lawfully peaceably & quietly have hold use occupy propels & enjoy the sd demised & bargain premises with the appurtenances free & clear & freely & clearly acquitted exonerated discharge of & from all manner former or other gifts bargains sells liens mortgages wills entails jointures dowries executions & extents whatsoever And further the said George Miller Rober Perry Thomas Bracher & John Perry their heirs exc & admst do covenant & grant to & with the said Arthur Lipsey his heirs & apsigns that all times hereafter upon the request & at the proper ex & charge of the sd Arthur Lipsey his heirs & apsigns make do & execute or cause or procure to be made and or executed all & every other reasonable acts or apurances in the law for the further better & more perfect apsuring & sure making & conveying the above sd track of land & premises to the said Arthur Lipsey his heirs & apsigns or his or their council learned in the law shall be reasonable advised devised & required & the said George Miller Robt Perry Tomas Bracher & John Perry for themselves & their heirs the above mentioned tract of land & premises & every part & parcel thereof from them their heirs & apsigns & all persons whatsoever shall & will warrant & defend for every by these presents.
